In Green County Deed Book 19, page 319, 11 Jul 1844 - The heirs of William and Sarah were listed as 1. John A Blanchard and wife Lucinda, 2. William R Jones and wife Rachel, 3. James and 4. Sarah (William's wife), who is guardian for 5. Benjamin; 6. Sarah; 7. William ; and 8. Luellen all of Buchanan County, MO. Later Deed Book entries listed Lewis T. Despain of Green Co. KY as a son.

Green Co, KY Stray Book #2 - Taken up by Wm. Despain 4 Jun 1838 at his home on the West Fork of Pitman Creek, one Jenny about 2 years old, 12 hands high.

Order Book 9, page 64, 18 Jun 1838: William was appointed guardian of Lucy Ann Kirtley, his granddaughter. She was born about 1834/35 in Green Co, KY. This is believed to be the female age 0-5 in William's household in the 1840 Warren Co, IL census. It is not known what happened to Lucy as she was not in 1850 census.

From Green County Settlements, page 746 - William was adminstrator of Adam Mutter's estate 30 Mar 1839. Results of the sale were recorded 7 Jul 1839. Items were purchased by William, Polly, and Martha Mutter as well as William DeSpain.

Green Co, KY Court Records: 10 Sep 1839 - promissory note - Elijah Gaddie promised unto William Despain, one year from date, $60.00

Green Co, KY Court Records: 18 Oct 1844 - Samuel Simpson, administrator of William Despain, deceased, plaintiff vs. Elijah Gaddie, defendent: Litigation invovlving a note executed 10 Sep 1839 whereby said Gaddie promised to pay unto William Despain $60 one year from date....suit brought to collect debt.

As shown in Green County Circuit Case #9732 William died in Lewis Co, MO probably in Jan 1841 in the part which became Scotland County in 1841.

This would seem to be one of William & Rachel's daughters, but she doesn't fit into the known family.

Thomas J Kirtley Tamara Parkison pointed out that from the court records, Thomas and Rachel were divorced 29 Jan 1836. 1832 - 1909 John Marshall Despain 76 76 John Marshall went to Des Moines Co, IA in 1849 when he was about 19. His exact age is not known as it varied in all the records. In 1850 he was living with his brother James Simpson and by 1856 he was married to Martha Mutter and living with his father, John. He moved to Coffey Co, Kansas 5 Nov 1857. John is thought to be a "true Jr." as his father was probably named John Marshall Despain.

Martha was the daughter of William and Susan (Despain) Mutter and therefore, a second cousin to John. This shows that there was contact between the Iowa and the Illinois Despains. She died before Jun 1866. None of the family was in the 1865 Kansas State Census. It is not known where they were or if they were missed..

Scotland Co, MO Deed Book 18, page 426: Sarah DeSpain to Jeremiah Lewis both of Scotland Co, MO for $400 her right of dower in land on Pit man Creek in Green Co, KY nera Jeremiah McFarling's 57 acres. Also a tract on Alex fork of Pitman Creek, corner to William DeSpain's Mill Race 125 acres. Also another tract of 53 acres.

The following is from the below mentioned Circuit Court Case:
Green Co, KY Circuit Court Case #9732, 5 Aug 1842 - Sarah DSpain vs. E. Gaddie: .....For replication to defendants first plea, plaintiff says she was appointed Administrator of William DeSpain in Lewis County, Missouri on 11 Feburary 1841 and before the institution of this suit and still is such and here exhibits her letters which she files with the Clerk -
"Lewis County Missouri:
To Sarah DSpain, Greeting
Whereas William DSpain of Lewis County, Missouri, deceased, having while living and at the time of his death had goods, chattels and estate in Lewis County, Missouri and died intestate, They commit unto Sarah DeSpain full power to administer the estate. They do ordain, constitute and appoint Sarah DSpain as adinistratrix."

In Green County Deed book 19, page 319, 11 Jul 1844 - The heirs of William and Sarah were listed as 1. John A Blanchard and wife Lucinda, 2. William R Jones and wife Rachel, 3. James and 4. Green Co, KY Deed Book 20, page 459, 30 Sept 1847 - Jeremiah Lewis and Sarah DeSpain widow of Wm. DeSpain dec'd and James DeSpain, Wm. R. Jones and Rachel, John Blanchard and Lucinda all of Buchanan Co, MO and Lewis DeSpain of Green Co, KY children and heirs of the said Wm. DeSpain to Walker Gill or $610 125 acres on Pitman Creek at the mouth of DeSpain Mill Race. Signed by Lewis DeSpain as their attorney and for himself.
1819 - 1870 Rachel Despain 51 51 Rachel married Thomas J Kirtley in 1834. It is not know what happened, but apparently Rachel ran off with William R. Jones about 1835. Rachel and Thomas had one daughter, Lucy, who was adopted by  her father, William Despain.

Rachel was identified as a daughter and heir of William in Deed Book 19, page 319.

He married Mrs. Dicy A. (Duncan) Young on 17 Jul 1853 in Andews County, MO. They had one known child born in 1858. It is thought that James died before 1860 as he was not in the household at the time of the 1860 census and Dicy had appearently remarried a Mr. Mullins.

James was mentioned in the original claim by Sarah Despain in Green Co, KY Deed Book 19, page 318 11 Jul 1844 as an heir of William Despain.
1825 Lucinda Despain Lucinda and John Blanchard were married 15 Feb 1841 in Scotland Co, MO

John and Lucinda were mentioned in Green Co, KY Deed Book 20 page 460, 30 Jan 1848 as heirs of William Despain.

BLM Land Records: Lucinda Blanchard, Buchanan Co, MO, recorded 10 Aug 1849, SWNW S36, T58N, R36W - 40 acres. Note - John A. Blanchard patented 72 acres in this same section.

It is not known what happened to his couple. They were not found in any subsequent records.
1826 - 1885 Benjamin Ryan Despain 58 58 Benjamin married Harriet Pickerle, duaghter of Simon and Mary (Hodgebeth) Pickeral, 22 Dec 1848 in Buchanan Co, MO.

In the 1900 Washington Twp, Buchanan Co, MO, Benjamin and Harriet had 11 children with 7 children living. This seems to be in error as Dixie <dixiebel@vum.com> listed 13 children with 9 living in 1900.

Some of the information on Benjamin's family came from Ellye DeSpain, wife of George Martin DeSpain, a great grandson.

Dixie (Shafer) Winkler, whose husband is a gggrandson, stated that many Despains are buried in the Despain Cemetery in the French Bottom area of St. Joseph, MO.

William married Jane Wilburn about 1854 probably in Buchanan Co, MO, but there is no record of this union. William may have left for a time as there were no children born from 1857 to 1862 and Jane was listed alone in the 1860 census. There are several unknown children's deaths as Jane claimed to have had 10 children. This may explain the childless period of 1857-1862.

Jane applied for a Civil War pension 17 Apr 1892 in KS. William served in Co. K, Eastern MO Milt. Infanrty.

1833 - 1901 Harriet J Pickerle 68 68 Bessie Winkler age 11 b. about Oct 1888 was living with Harriet in 1900. She was listed as her niece. This was an error; she was her granddaughter.

Harriet Despain was listed in the Buchanan County tax list in 1891,92,93,94,95,97,98,99,00,01.

1900 Census: Washington, Twp, Buchanan Co, MO page 9-40-1-22. Harriet 67,KY Wd...f- KY; m - KY. Jerry, 37, MO; Charles M. 30, MO; Bessie Winkler, 11, MO. She had 11 children with 7 living.
1910 Census: Centralia, Lewis Co, WA page 1666-131-20B. Harriet stated she had 10 children with 9 living.
1815 Jeremiah (?) Despain It is thought that William's first son would have been named Jeremiah based on the other children's names, but there is no proof. The family appeared to be close to Jeremiah Lewis who was named as an heir of William's estate. It is now known that Jeremiah is the younger brother of Sarah and purchased part of William's estate from her.

In the 1840 tax list for Buchanan Co, MO there was a Sarah Deshain. As she was listed in the tax list, it is assumed she was a widow.  Could she have been Jeremiah wife?  Was this Despain family on the way to Buchanan County to join their son when the father, William, died?
1817 - 1870/1880 Susan Despain Susan married William Mutter the son of Adam and Martha Mutter in Green County in 1834. William Despain was on bond and Adam Mutter gave consent. They moved to IL soon afterwards.

William Mutter was living next to William Despain in the 1840 Census Warren Co, IL.

Susan was not listed as an heir of William DeSpain in any of the Green Co. deed book entries.. It is not known if this was an over sight because William and Susan (Despain) Mutter were still living in IL or for some other reason.

Spain has become security for my mother, Sarah Despain, on a bond for the cost in the Green Cuircuit Court in a suit in chancery for her dower in certain lands claimed by her from Walker Gill and Elisha Gaddie and whereas the said Silas Despain has went bond at my request as security, I as the attorney for Sarah Despain, my mother, for myself, grant him all interest from said Gill and Gaddie."  Signed Lewis Despain

Lewis was named as a son of William and Sarah's in Deed Book # 19 page 442, dated 23 Dec 1845 Green Co, KY. Lewis was in the 1845 and 1846 Green County tax records. The last known mention of Lewis was in Green County Deed Book 20, page 360 dated 30 Jan 1847.

From Homer Ficken - A Lewis DeSpain died intrastate 3 Jul 1849 in Buchanan Co, MO. This was almost assuredly Lewis T. Court probate records might show if there was any issue of this family.

Lewis was married to Caroline Ellmore in Green County in 1844 by T. C. Graham. Surety was by Nicholas B. McCubbin her brother-in-law and consent was given by George Ellmore her father. It is not know if there was any issue of this union before Lewis' death.

Benjamin was married 5 Dec 1854 in Lane Co, OR to Susan Jones. She was the daughter of William R. Jones and Rachel Despain. Benjamin and Susan were 1st cousins, once removed.
