WILL OF MATTHEW PATTON pp. 300-301 Old Will Book C page 69 Cumberland Co. PA, Carlisle, PA.
In The name of God Amen, I Matthew Patton of Peters Township county of Cumberland and Province of Pennsylvania being weak in body but of sound mind memory and judgment Do make and ordain this my last will and Testament in the following manner and for Viz. First of all I order that all my just debts and funeral expenses shall be duly paid out of my personal estate and as to the rest of my estate real and personal of which I am or may die possessed of I give and allow to my wife ELIZABETH the sum of ten pounds yearly and every year to be raised of the half of this land on plantation during her natural life or so much grain wheat rye corn or the ?pike as shall be the value of ten pound according to the current price to be yearly given to her during her life If she shall choose the same or other than the money I allow her the use of this my dwelling during life and the half of the garden & for the privilage of waters and firewood on this plantation if she shall please to live it. I allow her what portion & any household funiture she shall choose and the rest shall be sold by my executors. I also give and bequeath to her my said wife my negro wench Sally to wait on her but if the said wench shall appear stubborn and not duly please her mistress I allow that my Executors at my wife request hire out the said wench and that the and that they (sic) hire a girl instead to wait on her mistress and also I allow my wife two cows to be at her own choice and to be kep by whoever of my children she may choose to live with and at their expense. I aso do by this will veirfy and confirm the deed of gift of the one half of this Loudon plantation and tract of land made to my son JAMES PATTON bearing date twenty fourth day of March in the year of our Lord one thousand and seven hundred and seventy three and Issuing to the terms and interest thereof and also the deed of gift of the said date made to my son SAMUEL the one half of the plantation on which he lives according to the terms of said deed therein expressed. I do give and bequeath to my son ROBERT the one full half of the plantation and tract of land whereon he now lives and allow the same full half to be divided off to him according to the rights priviliges granted and given by the aforementioned deed to my son Samuel that they may have of the said plantation ____ share and share alike. I give and bequeath unto my son JOHN the sum of fifty pounds and to my son MATTHEW the sum of fifty pounds and to my son THOMAS the sum of fifty pounds to be raised and paid at the time and manner following & I give to my grand daughters ELIZABETH WILSON and MARY WILSON the sum of Twenty pounds each. I allow the one half of this plantation on which I now live as reserved from the other half given by deed to my son James as above mentioned to be at the death of my wife should by indifferent men chosen jointly by my sons James, Samuel & Robert after paying the legacies bequeathed to my sons John, Matthew & Thomas & my two granddaughters Elizabeth and Mary Wilson the remains to be equally divided between my sons, James, Samuel & Robert. I allow my granddaughters as above not to be paid till they reach the age of Eighteen years. I give to my daughter SARAH the sum of five shillings if demanded and I order my personal estate to be sold (Except the reserves in power for my wife) & after discharging my debts the remainder to be put in interest & reserved to assist in paying the Legacies to my sons, John, Matthew, & Thomas & the grandchildren above mentioned. & Lastly it is my will ___ & all these to whom I have above bequeathed any portions of my estate shall hold the same for themselves their wives and assigns forever. I do nominate constitute & appoint my sons James & Robert Patton to be whole & sole executors of this my last will & testament & I appoint my friend James M. Dowell to be overseer of my will to see the same executed according to the Intent & meaning thereof. In Testimony whereof I have to this my last will (Renouncing & setting aside all other wills by one heretofore made) set my hand & seal the Sixteenth day of August in the Year of our Lord one thousand seven hundred and seventy six.
