There was no marriage record for John and Malinda in Green Co, KY. It is thought they were married in AL as their first children were born there. By tradition they were married in Madison Co, AL, but they were probably married in Jackson County as the Bazores were living there in the 1820s. It is not known if Scotty & Sally married before or after the move to southern Montgomery Co, VA near the North Caroline boarder. There are several male Petersons listed in Daniel Trigg's Company of Montgomery County, 31 Mar 1781. They may be her family. In the Circuit Court Case # 3977 papers, it is stated that Susan died a few days after James. Therefore she probably died just before 20 Jan 1835. Her surname is from W. W. Whitaker's files. However there does not seem to be any written proof of her name. It supposedly comes from one of her grandson being named, John Peterson DeSpain. Mr. Whitaker also mentions another grandson named James Peterson Despain.

Because Solomon is thought to be their child her death is assumed to have occured after 1783, but when or where is not known. However it is interesting to note that the births of the known children were strange. There is a gap of about 7 years between Benjamin and Peter and 8 years between James and Marshall. It is wondered if there are other children who did not live to maturity or are missing from the records. There are several Despains listed in New England in the 1830 and 1850 censuses which are unaccounted for...Joseph Despain and Samuel Despain 1830 Census: Grafton, Worcester Co, MA page 213; John Despain 1850 Census: Fairfax, Franklin Co, VT. It has now been concluded that these Despains are not from John and Susan's line.

As Samuel was dead before 1835 his children were listed in the Circuit Case #3977. His children were not in Green County in 1835/36. There was an unknown John DeSpain in the 1834 and 1837 tax list, but it is not known if this is Samuel's son, John P. Despain or not. Samuel was in the 1811, 13, 15, 18, 19, 20, and 23 Green Co, KY tax lists. There was a Samuel in the 1827, 28, and 29 tax lists, but it is not known if this is the same Samuel or not. Although he was in the 1820 tax list he was not found in the 1820 Green County census. There has always been a question if there was more then one Samuel. Could one of Peter's unknown sons be named Samuel? As a professional Rutherford County genealogist could not find any references to Samuel or Margaret between 1811 and 1830 in Rutherford Co, TN, it is now believed that the Samuel mentioned in all of the Green County records is James Scott's son. As Samuel is not in the 1816 & 17 tax lists, it is possible they did go to TN for a few years. In several tax years, most notably 1827 to 1829, Samuel was listed with 100 acres of land. No records of this land being bought or sold has been found in the Green County land records. His children were born between 1814 and 1824 and all listed their birthplace as TN, but they were probably born in KY and just considered TN their home state. Samuel's widow, Margeret, was found in Rutherford Co, TN in 1830 with no mention of Samuel. Ergo, Samuel died between the 1829 Green Co, KY tax time and the1830 Rutherford Co, TN census.....late 1829 to early 1830. W. W. Whitaker stated in the Despain Log Chain that based on bible records the DeSpain family associated with Rutherford Co, TN was "Saul" & Levicey Grayham DeSpain. This is in error; it is "Sam'l" & Margaret Freeman DeSpain. Samuel was James Scott DeSpain's oldest son. Scott never had a son named Solomon. Based on the Rutherford Bible referred to by Whitaker there was another son names James Perterson DeSpain. James married Margaret Matthews 12 Sep 1807 in Cumberland Co, KY. James & Margaret were only 16 at the time of their marriage by John Mulkey. They would have required consent which could have told us more about this couple, but unfortunately the Court House with all the records burnt down in 1933. We will probably never know why or how they met. It is suggested that James was visiting his Uncle Marshall DeSpain who was in area about this time. James D. Spain Jr. was over 16 but under 21 in the Green County 1808 & 1811 tax records. The last known record of James in Green Co, KY was the 1815 tax list. He is not in the 1816 to 1819 tax lists and it is speculated they were in Cumberland (Monroe) Co, KY as he is on the 1820 Monroe Co, KY tax list and the 1820 Monroe County census. As there is no further records of James in either Green or Monroe Counties, it is reasonable to assume he went with the Matthews, DeSpains, Daniels and Lewises, etc. in 1821 to AL. They apparently chose to located in Lauderdale Co, AL near Margaret's brother, Joseph, and James' Uncles, Marshall & Solomon. By 1828 they were living near Solomon and Nancy Despain in Shelby Co, TN and moved to Crittendedn Co, AR by early 1831. [NOTE: There is an unknown James DSpain in the 1820 Green County tax list and census record. These are very odd entries. James appear "out of nowhere" and he is taxed on 200 acres of ground and 10 slaves. The land has never been found in the deed books. In a few months when the census is taken he has no slaves listed while Hiram Despain who is listed next to him has 8 slaves without any land. This James never appears again in the tax lists or census records. This mystery is unresolved for the next generations of researchers to attend to.] James D. Spain was in Shelby Co, TN by 1828 as indicated by the non payment of his taxes according to the Sheriff. This is from Whitaker's notes who thought this was James Harris DeSpain. As James was dead by 23 Feb 1836, James' children were listed in the Circuit Case #3977. His children and wife were found in Crittenden Co, AR in the 1840 census. It is now known that James Jr. was in Crittenden Co, AR by 1831. 1820 Census: Monroe Co, KY page 211: 30001-2001 [Information from the Matthews Family Genealogy seems to prove that this was the correct James (De) Spain in 1820] 1820 Census: Green Co, KY page 77 : 210012-001 [James appears to be counted twice.] 1830 Census: Shelby Co, TN page 11 - 0011111-01101 [Ancestry IImage 19] - J. D. Spain This would appear to be James Jr. as his son, Samuel, married Celia Despain the daughter of Solomon Despain in Crittenden Co, AR about 1832. 1820 Monroe Co, KY Tax Records - Jas D. Spain, no land, 1 white male over 21, tax $0.50 Note: James was not in any subsequent Monroe County tax lists. Oliver Matthews, Margaret's nephew, also was only in the 1820 census and tax list. It is now known that Oliver died in late 1820 or early 1821. In the 1820 Monroe Co, KY census James had 5 children. As there are only 4 living in 1837, it is assumed that one had died. It is conjectured that James Jr. moved from Green County to Cumberland County (future Monroe) about 1816 and lived near his in-laws, the Matthews. The family moved with to Lauderdale Co, AL about 1821. After Marshall Despain's death the family migrated to McNairy Co, TN with the other Despains and Matthews. About 1827/28 he moved with his Uncle, Solomon Despain, to Shelby Co, TN were they were found in the 1830 census. Crittenden Co, AR Deed Book A page 258 - James D. Spain was a testor to the gift of land by Peter Fletcher to Catherine Allen on 27 Aug 1831. This confirms that James moved his family to Crittenden County and was still alive on 27 Aug 1831. He was able to read and write. As he was not involved in the court presentation in Dec 1831 or as a testor to other gifts by Peter Fletcher to Catherine Allen in Sep 1831 it is speculated he died that fall. --- Sources: 1. Joseph and Solomon Spain purchased items at the sale for Daniel Noe, 26 Jan 1815, Green Co, KY. In the 1830 census there was a male born 1820/25. This individual was not in the 1840 census. It is not known if he was gone, died or was not Joseph's son. He was not mentioned in the 1883 Circuit Court Case # 2463, so he was not a son of "Patsy" or he had no issue. It is now believed that he was not Joseph and Patsy's son. From Green Co KY Death Records: Joseph Dispain w, 86, male, married, farmer d. 9/10/1875 b. S.C. s/o Scott and Salley Dispain. This would put his birth about 1789 which is earlier then I have placed him. According to John B. This is believed to be the female age 0-5 in William's household in the 1840 Warren Co, IL census. It is not known what happened to Lucy as she was not in 1850 census. From Green County Settlements, page 746 - William was adminstrator of Adam Mutter's estate 30 Mar 1839. Results of the sale were recorded 7 Jul 1839. Items were purchased by William, Polly, and Martha Mutter as well as William DeSpain. Ben D Spain owed $0.33 in the settlement of John Burnet, guardian of James D. Allen 19 Mar 1832. Benjamin Despain was a debtor to Porter & Akins Mertcantile for $12.25, 25 Sep 1833. Deed June, 1838 - Benjamin DeSpain and wife, Edith, to William DeSpain ....$300 ....tract on Alex Fork of Pitman Creek ....bank of fork of Pitman Creek ....mouth of DeSpain's mill race ...125 acres. Wit: Harvey, Jinning, Elijah Davidson,. Warren Co, IL: James Turall and Gilbert Turnbull, JP states they know Benjamin and Edith DeSpain and acknowledge the deed. Benjamin moved to IL in 1834. He is in Warren Co, IL in 1840 and 1850 census. Jeremiah Despain's biography stated that the family arrived in Lane Co, OR in 1852. Actually Jeremiah and Benjamin Jr. went to OR in 1852 and returned to IL. Benjamin with his 4 youngest sons went to OR in 1854. Benjamin was a "Joseph Smith" Mormon and he possibly left IL because of all the trouble at Nauvee. Benjmain had Donation Land Claim #1115 taken out in ! Dec 1854 and signed by William R. Jones. He arrived OR 7 Aug 1854. Benjamin and his 4 sons bought about 1850 acres of farm land in Lane County and 4 1/2 city block of early downtown Eugene. They ran the first Oregon stage coach line and a livery business.. Sarah, 30, MO, was listed as a domestic with William 6, MO listed after her name. Lewis is in Green Co KY tax list 1834-37. He probably moved to IL in 1838/39. He was in Warren Co, IL in the 1840 census and Benton Co, MO in 1850 census. He was listed in the 1860 MO Mortality Schedule as dying in July at the age of 48 of dropsey. He was a farmer living in Benton Co, MO. Land Records: Lewis D Spain 1 Nov 1848 Benton Co, MO [Clinton L. Witnesses: William A. Gray and William P. Caldwell. Wife, Jane, to have a tract of land (Sec. 11, T 41, R 23) 160 acres to use until her death then it would go to his daughter, Ann. Other land, SE quarter of NW quarter of sec 13, T 41, R 23 to do with as wife, Jane, saw fit. Jane was the extrix. The will only mentions two children: William H. and Arminta Ann.
