David of Strathbogie, 10th Earl of Atholl, as which restored by Edward IIof England between 21 Aug 1307 and 20 May 1308; though stripped of suchtitle 1314 by Robert I (The Bruce) King of Scots after rebelling againsthim, even though made Constable of Scotland earlier by Robert; despitethe absence of any writ of summons from him to the English Parliament of20 Oct 1318 or genuine evidence of his sitting in it he is deemed by aHouse of Lords resolution of 7 May 1914 to have been created 1st Lord(Baron) Strabolgi (England) in virtue of a supposed writ of summons tothat body, even later writs of summons, however, were worded to "David(de) Strabolgi, comiti (ie. "Earl of") Atholl", rather than "domini (ie."Lord") Strabolgi"; granted by Edward II Feb 1312 Manors of Elton andCave, Yorks (forfeited 3 May 1313), and 8 Oct 1314 Manors of Aylsham,Causton and Fakenham, Norfolk, but sided 1317 on with Edward II'srebellious cousin Thomas, Earl of Lancaster, for which pardoned 22 Oct1318 and regranted Chilham 28 Nov 1321; Chief Warden of Northumberland1322; held a command in the English army in Gascony 1325; married Joan(died between 8 June and 24 July 1326), daughter of John Comyn ofBadenoch, and died 28 Dec 1326. Earl of Atholl, DAVID OF STRATHBOGIE, of Chilham, Kent, horn of John, 9thEarl, was restored by Edward II as EARL OF ATHOLL [Scotland], between 21August 1307, and 20 May 1308. On 23 Dec. 1300, he was a prisoner inEngland. On 16 November 1316 he had pardoni as "David Earl of Ascelles."Before February 1311/2 he had been constituted High Constable [Scotland]by King Robert Bruce, but, rebelling against him in 13 I4, his lands,office and title were forfeited by that monarch. In consideration,however, of his services to England, he was summoned to the EnglishParliament from 14 March (I321/2) 15 Edward II to 3 December (1326) 20Edward II, by writs directed "David de Strabolgi comiti Athol'," wherebyhe may be held to have acquired an English Barony in fee (LORDSTRATHBOGIE), though not an English Earldom. He was chief Warden ofNorthumberland, 1322, and commander of the English troops in Gascony,1325. He married Joan, sister and coheir of John COMYN, of Badenoch (whofell at Bannockburn 24 June 1314), daughter of John COMYN, of Badenoch(stabbed by Bruce in February 1305/6, by Joan, daughter of William DEVALENCE, EARL OF PEMBROKE.
