WILL OF MOSES PRESTON
Be it remembered that I Moses Preston of Franklin County and State of V
ir ginia being weak in body but of sound and perfect mind and memo
ry do ma ke and publish this my last Will and Testament in manner and fo
rm followi ng that is to say first I wish all my Just Debts to be pai
d. I will and be queath to my beloved wife Ana, her three children (to wi
t) Mahala, Davi d, and Jubal that part of my plantation and the ?????? la
nd inside of my p lantation until it comes to the ?????? land of the cr
op fence. It is under stood that the above land is only to be my wife's pr
operty during her life time or widowhood. None of her children is to distu
rb her on the land agai nst her will during her life or widowhood and aft
er her death or intermarr iage the land is to fall to her three children.
Next I will and give to my three oldest sons (to wit) Lorenzo, Booke
r, Me llon all of my land east of my crop fence and the woodlands on ea
st of t he direction of the crop fence. My son Lorenzo shall possess of h
is pa rt of the above land until the month of June 1831 at which ti
me if my s on Booker does pay him the sum of one hundred and eighteen doll
ars he sha ll be entitled to his part of the above land. My son Mell
on is not authori zed to dispose of his part of the above land until the m
onth of march 18 35 by which time if my son Booker pays him one hundred do
llars, he sha ll be entitled to his part of the above land. I give to my w
ife Sparkey a ll my household and kitchen furniture, plantation utensil
s, and stock exce pt the following properties which my son Booker shall ha
ve a bed, my ???? ?, and a gun.
I give my son Booker and my wife Sparkey the privilege to sell my pre
se nt crop of tobacco and what grain can be spared at probate se
ll to p ay  my debts. I hereby revoke all former wills made by me in testi
mony whe reby I have hereunto set my hand and seal this the 11th day of De
cember 18 27.
At a court held for Franklin County the 7th day of April 1828. Th
is la st will and testament of Moses Preston accepted in Court and prov
ed by t he oath of George Asbury, Calloway Ramsey, and Noah Ferguson. Fran
