In 1692 John Fontaine(Fountain), being an alien, was naturalized. (VIRGINIA HISTORICAL MAGAZINE, page 156.)
Quote:
"Naturalization of John Fountain, 1692."
---"An whereas yr. petitionr is an alien born & hath constantly resided within this government for ye space of twenty yeares at least & is now ready to performe what ye law enjoines him to doe he therefore humbly prayes yt he may be naturalized accordingly and he shal pray, etc."

In 1695 Mary Byrd relinquished her dower rights to "certain lands in the Jordans," to John Fountain. Quote:
"Mrs. Mary Byrd, by Richard Bland, her attorney, relinquishes to John Fountaine her right of dower in certain lands in Jordans." (CHARLES CITY COUNTY, VIRGINIA COURT ORDERS, 1687-1695, Abstracted and Compiled by Genjamin B. Weisiger III, page 206, dated June 3, 1695.)

In Orphans Court (indicating John was an orphan but of age) William byrd acknowledged the deed to John Fountain. Quote:

"P. 589. At Orphans Court at Westover 18 Sept. 1695. William Byrd acknowledged deed to John Fountain." (Same reference as above.)

In 1704 John Fountain appears on the Quit Rent Rolls of Prince George's County, Va. (VIRGINIA MAGAZINE OF HISTORY AND BIOGRAPHY, Vol. XXVIII).

In 1714, land belonging to John Fountain, deceased, was escheated and granted to Mrs. Frances Wynne. Quote:

"Mrs. FRANCES WYNNE, 142 Acs. (Escheat L.) Pr. Geo. Co., on S. side of BAILEY's Cr., bewg. at mouth of SIMMON"s Gut, on WM. RAYNE's line, 16 Dec. 1714, p. 199. Escheated from John Fountaine, dec'd for 150 acs. by inquisition under WM. BYRD, Esqr. Esch'r., upon survey returned by ROBERT BOLLING, Surveyor, found to contain 142 acs......" 9EARLY VIRGINIA FAMILIES ALONG THE JAMES RIVER, THEIR DEEP ROOTS AND TANGLED BRANCHES, CHARLES CITY COUNTY---PRINCE GEORGE COUNTY VIRGINIA by Louise Pledge Heath Foley, page 95.)

This would indicate that John Fountain died intestate before 16 December 1714 and his son, John, was not yet eligible to inherit, being underage. Quote:
"Dealing with minors prohibited under penalty of couble the amount."(STATUES AT LARGE, A COLLECTION of all the LAWS OF VIRGINIA, Vol. 1, page 269, ACT LIII, dated June 1642.)

Since John the father was an alien, the land was escheated by the crown. (Naturalization did not give the right for heirs to inherit; land could be devised, or willed, but not inherited if the person died intestate).

"Lands of aliens escheat to the Crown, at their death"(Same ref. as above, page 3, dated 1660.).

The land that was escheated can be seen, by its description and on a colonial map, to be "land in the Jordans." which later became Pr. Geo. Co. In 1717 John Fountain (this would be the one I have listed as John the Elder) and Robert Wynne received 175 acs. of land for importation of 4 persons. By that fact then we can assume that John was 21 by then.
If then his birth can be placed at about 1696. Quote:
JOHN FOUNTAIN & ROBERT WYNNE, 175 acs. (N.L.), Pr. Geo. Co, on S. side of Joseph Sw. adj. NATHANIEL TATUM, Junr., 15 July 1717, p. 341 Imp. of 4 persons: THOMAS BLACKENBINE, JOHN BUNCHLEY, JOHN JONES, RICH'D WHITCOMBE." (EARLY VIRGINIA FAMILIES ALONG THE JAMES RIVER, pages 99-100.).

IN 1745 JOHN FOUNTAIN APPEARED IN EDGECOMBE COUNTY. Quote:

"Pg. 448 ISAAC RICKS of Edge. Co. to GABRIEL PARKER of Edge. Co. this--day of Feb. 1745. 12 pounds curent money of Va. 150 acres more or less on the north side of Tosneott swamp in the low grounds of the swamp. Sit: JOHN FOUNTAIN, HENRY FLOWERS Reg. Edge. Co. Feb. Ct. 1745 Robert Forster C.Ct."(ABSTRACTS OF DEEDS, EDGECOMBE PRECINCT, EDGECOMBE COUNTY, NORTH CAROLINA, 1732 - 1758 by Margaret M. Hofmann).

The name Isaac Ricks can be found amont the early Quaker Records of Virginia. He and John Fountain were in the same area of Virginia before moving into N.C.

I believe John of 1692 was the father of John the Elder and son of one Edmond Fountaine for whom, in 1664 , Robert Wynne acted as security for Edmond Fountaine to pay McKenny L6 sterling; the security to be against the estate of Fountaine. Quote:

"page 473. Abstract. Capt. Robt. Wynne security for Edmond ffountaine to pay John Mackenny to value of L 6 Sterling. Attachmt to Wynne agst Fountaine's estate." (Mackenny's (McKenny) land was located near Bailey's Creek.NOTE ENTRY ABOUT MRS. FRANCES WYNNE AND THE 142 ACS. ESCHEATED TO HER FROM JOHN FOUNTAINE...IT WAS LOCATED ON THE S. SIDE OF BAILEY'S CREEK.)(VIRGINIA COLONIA ABSTRACTS, Vol. 12, CHARLES CITY COUNTY, COURT ORDERS, 1661-1664).

In 1635 an 18 year old John Fountaine came to Virginia from London. (PASSENGERS TO AMERICA; edited by Micheal Tepper). I dthink this was the beginning of our line in this country. This John that arrived was, I believe the father of Edmond, who was the father of John, who was the father of John the elder, the father of Henry, the father of William, Thomas and Henry.
