Richard FitzAlan, 3rd Earl of Arundel, 4th Earl of Surry, surnam ed "Copped Hat", Justiciar of North Wales, Gov. of Carnarvon Cas tle, Admiral of the West.

In 1330-1 he was fully restored in blood and honours and obtaine d restitution of the Castle and Honour of Arundel, becoming Ear l of Arundel.

 

Richard FitzAlan, [Copped Hat], 3rd Earl of Arundel, 4th Earl o f Surry. His marriage to Isabel le Despenser was anulled by Papa l mandate: "The powerful Earl desired to get rid of the woman t o whom he had been married as a child, and who, since her father 's attainder and execution, had ceased to be of any importance , that he might marry the woman with whom he was then living i n adultery; and the Pope very obligingly anulled the marriage an d bastardised the issue: a very unfair proceeding as far as Edmu nd d'Arundel was concerned." His second wife was first cousin t o his first wife and a Papal dispensation for the marriage was g ranted on 4 Mar. 1344/5

Took a distinguished part in the wars with France, was Admiral o f the West 1340-41 and 1345-47, commanded the second division a t the Battle of Crcy, and was at the fall of Calais in 1347.

 

On 30 June 1347 he succeeded to the vast estates of the family o f Warenne, by the death of his mother's brother, John, Earl of S urrey and Sussex, s.p. legit.

According to CP volume I pages 243 and 244, Richard Fitzalan, Ea rl of Arundel was, as a child, married to Isabel Le Despencer an d fathered two children. Then after the fall of the Despencers , he requested an annulment of that marriage, which he receive d as well as the declaration that the two children were illegiti mate and "married secondly 5 February 1344/5 at Ditton (a lady w ith whom he had previously cohabited), Eleanor of Lancaster.

Vol. 14, p. 38 gives a lengthy expl anation referring to several fines in 1347 and 1354 on the settl ement of the Arundell property, which begins with "He (the young er Richard Fitz Alan) appears to have been the illegit. s. of hi s parents..." and includes the change of his birth from 1346 t o "before 1347."
