                                                   SYNOPSIS OF LAST WILL AND TESTAMENT
JONATHAN LINDLEY
March 21, 1846
                                                                   Parke County, Indiana

Know all men by these presents that I Jonathan Lindley of the County of Parke and State of Indiana considering the uncertainty of this mortal life and being of sound mind and perfect memory do make and publish this my last will and testament in manner and form following (that is to say), First, I give and bequeath unto my beloved wife Susanna Lindley all of my household and kitchen furniture one cow six sheep twenty five dollars in money and for maintenance off of the plantation I now live on during her life I likewise give her and my daughter Elinor Newlin jointly full privileges and authority over the house I now live in with the apartment on the north side and the porch on the south of the same during her life
I give and Bequeath unto my daughter Elinor Newlin the lot or parcel of land described as follows beginning at the southeast quarter of section Twelve in township seventeen North of range Eight West thence running East one hundred and thirteen poles and a half to the grave yard thence North twelve poles to a beach tree thence east seven and three tenth poles to a stake near the forks of the branch thence North sixty two degrees west forty poles to a stake thence South fifty eight degrees west sixteen and seven tenth poles to a stake thence North Eighty degrees west thirty eight poles to a beech sapling thence south sixty degrees west twenty seven poles to the west line of said quarter thence South sixty six poles to the place of beginning containing Fifty acres and thirty two hundredth I likewise give her full privilege and authority to one third part of my orchard and in conjunction with her mother the house I now live in for the term of ten years from the time of my decease and if said Elinor shall outlive her mother then and in that case she shall have full privilege and authority to said house and a third part of said orchard for the said term of ten years.
I give and bequeath unto my son in law George Towel the following described lot or parcel of land beginning at the Northwest corner of the South East quarter of section Twelve in Township seventeen North of range Eight West thence running east sixty poles and five tenths to a stake thence South Eighty seven poles to a stake thence North Eighty degrees West thirty eight poles to a beech sapling thence South sixty degrees west thirty seven poles to the west line of said quarter section thence North ninety four poles to the place of beginning containing thirty two acres and fifty two hundredth.
I give and bequeath unto my daughter Ruth Atkinson the following described lot or parcel of land Beginning at the south East corner of the South East quarter of section Twelve in township seventeen North of range eight West thence running west thirty two poles to a stake at the corner of the grave yard lot thence North thirty five degrees west fourteen poles to a stake at the North East corner of the graveyard lot thence North ten degrees west fifty one poles to a stake near the forks of the branch and thence North sixty two degrees west forty poles to a stake thence South fifty eight degrees west sixteen poles and seventeenth to a stake thence North eighty seven poles to a stake on the north line of said quarter section thence East ninety nine poles and five tenths to the North East corner of said quarter section thence South with the range line one hundred and sixty poles to the place of beginning containing seventy six acres and twenty five hundredths.  I likewise give and bequeath unto the said Ruth Atkinson the following described lot or parcel of land beginning at the South west corner of the West half of the South West quarter of section seven in township seventeen North of Range seven West thence running East fifty six poles to a stake near the branch thence running with the general course of the branch north fourteen degrees east seventy one poles to a sugar tree thence north twenty five degrees west twenty six poles to a sugar tree thence North seventy one degrees west forty five poles and eight tenths to a poplar tree thence North thirty seven degrees west thirty one poles to the west line of said half quarter to where the branch crosses the same  thence south one hundred and thirty one poles to the place of beginning containing forty two acres and twenty nine hundredth.  The two last lots of land I give and bequeath unto the said Ruth Atkinson on the following condition first that she shall pay or cause to be paid unto my daughter Sarah Siler her executors or administrators for the sole use and benefit of the said Sarah Siler or the heirs of her body (in case of her death before said money be paid) the sum of two hundred and fifty dollars to be discharged in equal annual installments of forty one dollars sixty six and two third cents each the first instalment to be come due in twelve months from this will is established second said Ruth shall  shall also maintain her mother during her her mothers life and thirdly she shall permit her mother to live in the house I now live in during her life and forthly Eleanor Newlin and her mother shall have full possession of said house and one third part of my orchard for the term of ten years from the time of my decease.  And if she the said Ruth Atkinson shall comply with the conditions aforesaid or shall cause the same to be performed then and in that case the two last described lots of land with all the privileges and (?) there unto belonging containing together one hundred and eighteen acres and fifty four hundredths shall be her property during her life and after her death said land shall be inherited by her sons Jonathan and Ellwood Hadley jointly and equally.  I give and bequeath unto my grandson George Lindley son of Hiram Lindley one hundred dollars.  The balance of my estate not otherwise disposed of I give and bequeath unto my sons Geroge David and Lot Lindley to be equally divided between them.  And lastly my will and desire is that George and David Lindley my sons be the Executors of this my last will and Testament hereby revoking all former wills by me made In witness whereof I have hereunto set my hand and seal this the twenty first day of the third month in the year of our Lord one thousand eight hundred and forty six

presence of us who have hereunto subscribed our names as witnesses thereunto in the presence of the said Testator and in presence of each other

In the Parke County Probate Court December Term 1850
Be it remembered that on this ninth day of December 1850 the foregoing instrument of writing purporting to be the last will and testament of Jonathan Lindley late of said County Deceased was produced in open court by George Lindley and David Lindley the executors therein named for Probate and there upon  came into Open court David T. Lindley and Joseph Lindley the subscribing witnesses thereto who being first duly affirmed in open court and by the court fully examined as such witnesses in relation to the facts and circucumstances of the subscribing attesting and execution of the said will do severally each for himself depose and state that they saw the said Jonathan Lindley sign and seal the same that they heard him publish the same as and for his last will and testament he requested them to bear witness thereto that the said Jonathan Lindley was at the time of sound mind and memory and not under any coercion and restraint but free to devise his property according to his own free will and desire that the said Jonathan was at the date of said will aged about seventy six years that said will was executed as aforesaid on the same day it bears date at the dwelling house of the said testator in the County aforesaid that they subscribed their names thereto as such witnesses in the presence of the said testator at his request and in the presence of each other & further say not

And the court being satisfied from the proofs & examination aforesaid that said will was duly executed that the said testator at the time of executing the same was of full age to devise his property of sound mind and memory and not under coercion and restraint doth order that the said will be admitted to Probate and that the said will and proof & examination be recorded by the clerk according to law.

I John G. Davis clerk of the probate court of the said county do hereby certify that the attached and foregoing last will and testament of Jonathan Lindley deceased was presented before the said court at the December term 1850 by the Executors therein named and was duly proven and admitted to Probate upon the testimony and examination of David T. Lindley and Joseph Lindley the subscribing witnesses thereto as above set forth and that a true full and complete record of the said will and the proofs and examinations aforesaid have been entered upon record in my office in record of wills Vol 1. page 283-284-285 witness John G. Davis clerk of said court and the seal of said court this 14th day of December AD 1850
