Nicholas de was born before 1258 in Heleigh Castle, Audley, Staffordshire, England.  Nicholas de's father was James de Audley , of Heleigh, Sheriff of Salop and his mother was Ela Longespee.  His paternal grandparents were Henry de Audley , of Heleigh, Sheriff-Stafford and Bertrade (Bertred) de Mainwaring; his maternal grandparents were William II Longespee , Sir Knight and Idoine de Camville. He had four brothers and a sister, named James de, Henry de, William de, Hugh 1st Baron de and Joan de.  He was the second youngest of the six children.  He died on August 28th, 1299 in Heleigh Castle, Audley, Staffordshire, England.

‌Nicholas de and Catherine were married in a religious ceremony on October 23rd, 1288 in Brimsfield, Gloucestershire, England.  They had two sons named Thomas de and Nicholas 1st Baron de.
