  DEATH: James Worthy died as a result of injuries sustained during the Civil War.

  I, James Worthy of the County of Moore and State of North Carolina, being of sound mind and memory do make an publish this my Last Will and Testament in manner and form following that is to say:
  Item 1st I desire that my executors shall provide for my body a decent burial suitable to the wishes of my relations and friends, and pay all funeral expenses with my just debts howsoever or to whomsoever owing out of any money that shall first come into their hands as part and parcel of my estate.
  Item 2nd I give and devise to my beloved wife, Sally during the term of her natural life all that tract or parcel of land on which I reside on Cain s Creek containing five hundred and sixty acres more or less originally in two tracts but regarded by me as one; and after the death of my wife Sally I give and devise the said described land to my four daughters by my last wife (to wit):
  Mary, the wife of William A. Phillips; Jane, the wife of Gaston Thompson; Amanda, the wife of Samuel E. Johnson; and Nancy Worthy to be equally divided among them. My will is that my daughter, Nancy Worthy have the lot on which my dwellings are situated.
  Item 3rd I give and bequeath to my beloved wife, Sally my negro boy Rusco (aged 25 years), and my negro boy, Jerry (aged 9 years), and my negro girl, Alice (aged about 17years), and one horse, her choice of my stock, two cows and calves, her choice of my stock, and one head sted, bed, and furniture, and the worth of fifty dollars of such other furniture as she may like, and five hundred dollars in money, all of which property I desire she may dispose of at her death as she thinks proper.
  Item 4th I have already given to my beloved son, Kenneth H. Worthy a tract of land by deed on the Governor s Creek in said County which I intended for his share of my real estate and hope he will be there with contented.
  Item 5th I give and devise all the balance of my land not herein disposed of situated on the waters of Governor s Creek and a small tract on the waters of Dunham s Creek known as the Peterson's old place to my daughters by my first wife (to wit): Elizabeth, the widow of Angus McCaskill; Catherine, the wife of John McDonald; and Margaret, the wife of Joseph J. Monger to be equally divided among them share and share alike; and if before said division any of my daughters die leaving heirs of her body, I desire the share of such daughter to the heirs of her body as aforesaid; and should any of my daughters die without leaving any heir or heirs of her body at the time of such division then I desire her share of said land to go to her sisters and the heirs of any deceased sister in manner aforesaid.
  Item 6th My will and desire is that all the balance of my estate not herein disposed of before, be converted by my executors into money upon such terms as will best advance its interest of my Estate, and that the proceeds or money after paying all my first debts be equally divided and paid over as soon as practicable to all my beloved children sons and daughters share and share alike; and should any of my children die before said division is made leaving heir or heirs take the same share that his or her ancestor would have taken had he or she been living.
  Item 7th I will, desire, and bequeath to my beloved daughter, Amanda Johnson wife of Samuel E. Johnson and to the heirs of her body all that part of my Estate that is intended for her and that she takes by the provision, of this my will to have and to hold the same to her and their sole and separate use and benefit. The said Estate or Property hereby devised and bequeathed to my said daughter and her heirs of her body as
