         William Phelps Sr. was born say 1593 at Crewkerne, Co. Somerset, England.5 He was the son of William Phelps. William Phelps Sr. was baptized on 19 August 1599 at Abby Church, Tewkesbury, England. He married Mary (?) say 1617. William Phelps Sr. married Anne Dover on 14 November 1626 at Crewkerne, Co. Somerset, England. William Phelps Sr. died on 14 July 1672 at Windsor, Hartford Co., CT.6
    
    adopted a constitution for the Connecticut
    colony. This document recognized no
    authority save God, superior to that delegated
    by the people. That document was drawn up
    by Mr. Roger Ludlow presiding magistrate,
    with the assistance of the magistrates, of
    whom William Phelps was one.
    On 4 January 1638 William Phelps
    with Messrs. Haynes, Ludlow and Hopkins,
    were established as a committee to settle
    Plymouth Colony claims to land on the
    Connecticut River. The Plymouth people had
    waved their rights to land in Windsor in May
    1637, except for the trading post which they
    had not given up.19
    Any persons who wished to become
    settlers in those towns were carefully
    scrutinized for a good, moral character. No
    two young, single men could set up living
    quarters together without Court permission.
    An Oath of Fidelity was framed by the General
    Court in 1640, which was administered by the
    magistrates, to all males above 16 years of age.
    The oath commenced: "I, AB, being by the
    Providence of God within the jurisdiction of
    Connecticut, doe acknowledge myself to be
    subject to the Government thereof, and doe
    sweare by the great and dreadful name of the
    everliving God to be true and faithful unto the
    same." It was designed to impress upon the
    young men their duties as responsible
    citizens.20
    On 13 December 1653, William Phelps
    was designated as one of a committee of five
    to advise with the Constable in preparing
    twelve men for and Indian War.
    On 7 April 1663 there is a record of
    William Phelps paying 9 shillings for the poor
    and wanting in other towns or colonies.
    The original 1636 Phelps residence in
    Windsor was on the road running northerly,
    three-quarters of a mile northwest of Broad St.
    on the road to Poquonock and was a short
    distance north of the mill in Mill River Valley.
    It was in line with the home of Rev. John
    Warham.
    The Connecticut State Library has a
    document written in 1661 which was signed by
    four of the magistrates, including William
    Phelps. It gives his Signature.21
    William died in Windsor 14 July 1672.
    He was buried in Windsor the following day.
    He was honored and respected by all. It has
    been written of him, "He was one of the most
    prominent and highly respected men in the
    Colony, an excellent, pious, and upright man
    in his public and private life, and was truly a
    pillar in Church and State." His wife died in
    Windsor 27 November 1675.
    The following is the last will and
    testament of William Phelps, or properly
    speaking, his Settlement Deed, from Windsor
    Records.22
    These presents testify, that I, William
    Phelps, of Windsor, on Connecticut, in
    consideration of a marriage concluded
    between my son Timothy, on the one part, and
    Mary, the daughter of Edward Griswold, on
    the other part; have given and granted, and by
    these presents do give and grant unto my son,
    that he, the said Timothy, shall jointly enjoin
    and possess, together with me, all my housing,
    lands and accommodations, as also all my
    estate, both real and personal, both within
    door and without, with all the property
    emoluments, products, and income of the
    same, during my material life. And my said
    son is to inhabit and dwell in my house, with
    me and my wife, in joint way; and that it shall
    continue during my material life; and if my
    wife shall survive me, she have and enjoy in a
    joint way with my son the estate for her
    maintenance as before expressed. But if my
    wife chooses to settle in any place and to leave
    the house, then my son shall pay yearly to my
        
    set them to work. William met both of these
    needs. He was a member of the congregation
    of Rev. John Warham and well aware of the
    plans and needs of this undertaking. His
    respect for the leaders would have been an
    important factor in his decision to transplant
    his family to a wilderness.
    William came from Crewkerne as did
    Rev. John Warham. He was likely influenced
    by Rev. Warham to trade his stability in the
    Old World for the opportunities of the New
    World, and thus to sail on the Mary and John.
    How these families and individuals came to
    unite on this ship, settle Dorchester, Mass., and
    for the most part, move to the new frontier on
    the Connecticut River to settle Windsor, will
    not be entirely known. We are dealing with
    people who left few family records other than
    vital statistics which were recorded in church
    and civil records.
    It is known that the Rev. John White
    was a man of energy and drive. He was
    instrumental in organizing the large migration
    to Massachusetts in 1630 and especially he
    masterminded the group which sailed on the
    Mary and John. They seemed to be his hand
    picked group with the Minister, Rev. Warham,
    chosen by him.
    William was a prominent citizen of
    Dorchester from the beginning. He applied to
    be a freeman 19 October 1630. That was the
    first session of the General Court, which was
    held in Boston. It was attended by all freemen
    as no representatives had been elected.
    He was one of a jury of twelve
    empaneled for the trial of Walter Palmer,
    concerning the death of Austin Brotcher.
    Palmer was found not guilty of manslaughter.
    This was the first jury trial in New England
    (empaneled 9 November 1630). The Colonial
    records show his surname spelled also as Felps
    and Phelips.
    
    William was chosen constable of
    Dorchester, 27 September 1631 (also 4 March
    1634/5) and on 9 May 1632 he was one of a
    committee of sixteen chosen by the colony to
    see about the raising of a public stock.3
    Few records of Dorchester exist before
    1633. Those early records probably contained
    many records of the first allotments of land as
    that was one of their first priorities. Taxation
    was also a first order of business with this as
    any civilized society. On 3 November 1633, a
    general rate was levied throughout the
    plantation for the building and maintenance of
    gates, fences, and bridges. Raters appointed
    were William Phelps, Henry Wolcott, Mr.
    Johnson, George Hull, Eltweed Pomeroy and
    Giles Gibbes.4
    On 4 March 1634/5 William was one
    of a committee of three, delegated to lay out
    the bounds between Boston and Roxbury, and
    the same year was one of three delegates
    chosen from Dorchester to attend the General
    Court.
    March 4, 1634/5 Ensign Gibbs and
    William "Felpes" were appointed by the
    General Court to go with a committee of three
    to arrange the bounds between Boston and
    Dorchester, and explain what each town
    wants.5
    He was a member of the General Court
    from Dorchester, 5 May 1635, held in
    Newtown, now Charlestown.
    Mr. Newbury and William Phelps were
    appointed a Committee to set out the bounds
    between Wessagusens and Barecove on 8 July
    1635.
    Subsequently William helped set
    bounds for other towns. This is a quote from
    one of his reports, dated 3 September 1635:
    
    
    William was baptized in Tewkesbury Abbey on August 19, 1599, as son of William and Dorothy Phelps. He was twelve and his brother George was only five at the time of their father's death in 1611. Their mother died about two years later. There is no information on these brothers' lives in the next decade. William married about 1618, Mary (earlier texts say Elizabeth, see TAG), who may have been a Marshall. Their first son was baptized in Twekesbury on December 26, 1619.
    
    They may have left then for Exeter, Devon, for Marian Merritt says William Phelps was from the county town of Exeter. When they sailed for American in 1630 they brought their six children. Mr. George E. Phelps lists these as born in Tewkesbury but McBride saw no baptismal records for them there. It is possible they were on some of the ruined sheets and certainly, if born at Exeter, must have been on their lost sheets.
    
    William's Wives
    
    Henry R. Stiles in his History and Genealogy of Ancient Windsor, states that william Phelps married first Elizabeth (---), who died in Dorchester, that he married second in Windsor, Mary dover, and that she died on 27 Nov. 1675, he having predeceased her on 14 July 1672.
    
    These statements are repeated by Phelps Fam. 1:72-86, Maude Pinney Kuhns (The Mary and John, and other works such as Spear (7:63), with the addition of the years 1635 for Elizabeth's death and 1638 for the marriage to Mary Dover. Charles Edward anks, however, gives the name of the wife with whom William Phelps emigrated as "Mrs. Anne Phelps," without, unfortunately, a citation (Planters p. 90).
    
    No evidence has been found in American sources for these assertions. the dorchester vital records do not include those families that left for Windsor before 1643 and have nothing on the death of any Phelps. Windsor records do not include the claimed marriage to Mary Dover, and we have no evidence of her first name. The death record simply names "William Phelps his wife".
    
    The Crewkerne records prove that William Phelps had an apparent first wife, named Mary rather than Elizabeth, and that after her death he did indeed marry a Dover. The published assertion about mary dover may be a confusion of these two wives, or possibly the misapplication of an unidentified document in which Phelps mentioned a Dover as a relation.
    
    Whatever the case, no evidence has been found for the claimed marriage to Elizabeth or for the claimed marriage to Mary Dover. The conclusion that the latter marriage occurred in 1638 probably came from the birth of Timothy, in August of September 1639. The gap of five years between Timothy and the last child Mary in 1644 suggests that Mary may have been a menopause baby.
    
    THE MARY AND JOHN
    
    The Phelps did sail from Plymouth about 40 miles from Exeter where they joined other families from the southwest counties of England led by the Rev. John White the "great patron of new England migration." The group selected John Maverick and John Wareham as their ministers. There is an inscription for Wareham in the Palisade Cemetery, Windsor, Connecticut. William Phelps was a member of the original congregation formed in England to establish its own colony and church in New England.
    
    Before sailing they kept a solemn day of fasting, preaching and praying in the New Hospital in Plymouth. The party of 140 set out on March 20, 1630, in the Mary and John of 400 tons, described as Mr. Ludlow's vessel, with Capt. Squab, and arrived on May 30. A misunderstanding between the passengers and Captl. Squab led to the ship's company being put off at Natasket (Hull) instead of Charleston. Ten males set out afoot to Charleston Neck and Watertwon, were received, scantily fed and then returned to their group. They found pasturage for their sea-weary animals at Mattapan and named it Dorchester in honor of Rev. White and many of the group from Dorchester. of the man "past middle age and of good estates" were William Phelps, Henry Wolcott and Thomas Ford, and among the young men were Israel Stoughton, George Minot and Nathaniel Duncan. These families have a way of turning up in the Marshall family which is one clue that Elizabeth Phelps had been a Marshall. Their oldest son sailed to Barbgados in the company of other Marshalls soon after his mother's death.
    
    Dorchester, Mass.
    
    The Phelps stayed at Dorchester where, from the first, William Phelps was a prominent and highly respected citizen. On October 19, 1630, he applied as freeman. On November 9th he was on the jury for the trial of Walter Palmer for the murder of Austin Brotchus -- the first trial by jury in New England! He became Constable fo Dorchester on September 27, 1631, and on March 4, 1634, was appointed by the general court to go with a committee to arrange the boundary between Boston and Dorchester. On May 5, 1635, he was a member of the general court for Dorchester. From then on he has many mentions in both Massachusetts and Connecticut.
    
    Windsor, Conn.
    
    During this time the Dutch in New Amsterdam, having explored the Connecticut River to (now) Enfield Falls and wishing to have more settlers along the river to reinforce their settlements, sent an embassage to Plymouth. Soon each questioned the other's rights to be there and each reinforced their lines. In 1634 plans were made by the English to occupy the valley. In 1635 William Phelps was on a commission appointed to govern Connecticut as a separate colony. He signed the agreement with Mr. Prince of Plymouth for the Windsor lands, 7 miles west of the river, paying the Indians 2 coats, 40 shilllings in wampum for a third coat and 15 extra shillings. Later, not being able to prove full payment, he honestly bought it over again (1665) for 4 trucking coats or "whatever will satisfy."
    
    William Phelps moved with his children to Windsor early in 1636. He had first built on the south side of a rivulet there with his brother George a little closer into the settlement. William's lot measured six rods wide, but "being drowned very deep in a flood of 1638" he removed to higher ground. When he moved to higher ground he described his new location as "bounded at one point 40 rods from my dwelling house where it is bounded South by a little brook that falls into the river (Farmington)." Samuel Phelps and John Bartlett witnessed the deed there. This was his meadow lot out on the Poquonock Road just before one comes to Stoughton House, the old stone fort.
    
    William continued his responsible place in Windsor. As a member of the general court in 1637 he declared war against the Pequots. He was a magistrate from 1638 to 1642 and from 1658 to 1662 and foreman of the first grand jury in 1643. He was frequently mentioned as on the petit jury and in 1641 was appointed with a Mr. Welles of Hartford on a committee on lying! It is said that he was an excellent, pious upright man in his public and private life and truly a pillar of Church and State. By the time he had grown elderly and had a son of his name, he became known as "Ould Mr. Phelps" and as such the old church record enters his death on July 14, 1672, after a 42-year residence in New England of which 36 were spent in Windsor. He was buried on the 15th day of July. No probate has been found for William Phelps; he had probably distributed his property among his children before his death.

    (Abt 1592 - July 14, 1672)

    New discoveries in the parish records of
    Somerset indicate that the immigrant, William
    Phelps, was in the area as early as 1618. There are
    Phelps baptismal records in the Phillimore's
    printed indexes of Crewkerne, in the Somerset
    Record Office in Taunton and in the Somerset
    I.G.R. records that appear to list the children of
    William Phelps of Windsor, Conn.
    
    These names and baptismal dates
    match very well the names and estimated
    birthdates of the children of William Phelps of
    Windsor. The near duplicate baptismal entries
    in Parlock and Crewkerne, Somerset, suggest
    William Phelps may have first lived in Parlock
    and then moved to Crewkerne, about 50 miles
    southeast of Parlock. It is not uncommon to
    find baptisms listed in two parishes, the one
    where it took place and the original home of
    the parents.
    William may have had three wives, the
    third may have been Mary Dover, mother of
    Timothy and Mary. Ann Dover and Mary
    Dover may have been sisters who both came
    on the ship, Mary and John.2
    
    William and his family came to New
    England in 1630 on the Mary & John with his
    younger brothers, George and Richard, and
    Rev. John Warham. William was well
    established in England, with property and
    influence. William was, with Thomas Ford, of
    the Gentleman class. They first settled in
    Dorchester, Mass. along with the other
    passengers on that ship.
    Those who came on the Mary and John
    had been well organized and chosen by John
    White who had taken special interest in this
    ship. First, there must be governors and rulers,
    people of experience and at least gentleman
    class. Second, men of substance were
    essential. These men were needed with
    working capital to employ the poorer ones and
    "The bounds laid out between Hingham
    and Weymouth, by order of the General Court
    by Mr. Newbury deceased, and William
    Phelps."
    "The ryver between Hingham and
    Waymothe [Weymouth], running on the East
    syde of the ryver, that creeke being their
    bounds to the head of it, to an oake marked,
    and soe their lyne to run into the countrie,
    upon the same poynt that boundeth Boston and
    Waymothe. Also wee appoyncted Waymothe to
    make use of all the timber on Hingham syde,
    from a cove called Lovells Cove upwards in
    the ryver halfe a myle in bredth and three
    quarters of a myle in length, for the space of
    forty yeares; also wee prhibited Waymothe for
    making any improvemt of the ground."

    His wife reportedly died in Dorchester
    in the spring of 1636 and he moved his family
    to Windsor, Conn. soon after. He moved with
    the exodus of Rev. John Warham and most of
    his congregation, which was in the fall of 1635
    and the spring of 1636.
    William Phelps and his family moved
    with Roger Ludlow, Henry Wolcott and others
    in April 1636. Rev. Warham arrived in July
    but left his family behind until a decent home
    could be prepared for them.7 They settled at a
    place called by the Indians, Matianuck. It was
    named by them, Dorchester, but latter the
    name was changed to Windsor. The overland
    journey was 92 miles and took three weeks,
    following Indian trails. Some made the
    journey by ship, as did most of the women and
    children and most of their supplies. William
    and his family traveled by ship. Their hearts
    must have been full of excitement as they first
    viewed the broad stretch of meadowland which
    was to be their home; but, they must have also
    felt the reality of starting over to build a town.
    It must have been an awe-inspiring sight, a
    second initiation into the American wilderness.
    Those few who had migrated the previous fall
    had suffered terribly and were so excited to
    welcome them to their new home. This was
    the new frontier.
    This journey has been described as
    follows:8
    "Never before had the forests of
    America witnessed such a scene as this,
    driving their cattle before them, -- the compass
    their only guide -- through the bewildering
    mazes of the unbroken forest, commencing and
    ending each days march, with songs of praise
    and heartfelt utterances of prayer, which
    sounded strangely amidst these solitudes.
    They journeyed on through the chilly
    November days. That which is now a journey
    of but a few hours . . . was then with them (the
    women, children and cattle) a journey of two
    weeks."
    The Thomas Hooker party settled ten
    miles down stream at the old Dutch fort which
    became New Town and later Hartford. Others
    settled further down stream at Pyquag which
    later became Wethersfield. The Windsor
    group were mostly the Warham group and
    most of them were Puritans who had come to
    America on the Mary and John in 1630.
    Records do not exist for the first land
    distribution in Windsor, but it seems probable
    that they were made by a few key people such
    as Ludlow and William Phelps, the two
    Windsor commissioners, and Henry Wolcott
    the constable. Rev. John Warham and his
    three ruling Elders may have also been
    involved. By 1641, it was reported that 16,600
    acres had been allotted.

    The village streets were different than
    those they had known in their native Dorset
    and Somerset. The first cabins were small and
    primitive, the homelots were spacious, about
    five acres. This was one of the motivating
    factors for immigration. Each homelot
    contained corn and vegetable patches, cow
    pastures and orchards. With an average street
    frontage of 300 feet, their lots were spacious
    compared to their English experience. These
    landholdings must have been a great
    satisfaction to them.
    The first item of business that first year
    in Windsor was to prepare for the coming
    winter. There were crops to plant and harvest,
    land to clear, houses to build and stock to care
    for. Most of their supplies were lost in a sloop
    wrecked on its way from the Bay.
    Unfortunately some of them misjudged the
    capacity of the river and built their homes in
    the meadow, too near the river. William was
    one of those. He would pay the price later.
    By the fall of 1636, the new plantation
    was securely established. Some estimates are
    that there were in Windsor at that time, 50
    families and 235 souls. This group was
    persistently cohesive. They were bound
    together by a common background and faith in
    a dynamic religious leader, Rev. Warham.
    They were constantly aware of their weak and
    exposed position on this remote frontier. The
    elements of nature were intimidating; but, they
    were also threatened by the Indians, other
    Englishmen and the Dutch who were at the fort
    and were claiming the lands along the
    Connecticut River.
    Each spring there was a sharp rise in
    the level of the Connecticut River following
    the breaking up of the ice. In 1639 the
    flooding commenced March 5th and continued
    by stormy wind and heavy rainfalls to the 18th,
    when the waters were at the highest ever
    known by the Indians. The homes of the
    than territorial claims by alien interests. At
    that court "It was ordered that there shall be an
    offensive war against the Pequots."18 This
    same reference states that in 1638 the people in
    Connecticut admitted (or declared) that they
    were out of the jurisdiction of the
    Massachusetts colony.
    The Indian problem was the most
    crucial issue to be faced by the new colony. In
    fact, the importance of this event and the
    decision that had to be made has never been
    surpassed even until this time. The question
    was this: should war be declared against the
    most warlike and powerful tribe of Indians in
    all New England, the Pequots? They had
    constantly stolen from the Englishmen and the
    friendly River Indians. They had murdered
    some Englishmen and had abducted two young
    ladies and carried them off by force.
    The future safety of property and the
    very life of the new colony depended upon this
    decision. Their numbers were so small and the
    Indians so many. The Indians were a ferocious
    and warlike people which made it unthinkable
    to wage war against them. On the other hand
    it was equally unthinkable to continue at their
    mercy as they attacked the Englishmen on a
    random basis. William Phelps helped make
    that decision. Their lives and the lives of their
    families were at stake as well as the future of
    the colony. Though they were few in numbers,
    they decided to boldly declare war on the
    Pequots and trust in God for the results.
    In the battle that followed with a little
    army of 77 men, only two were killed and 16
    wounded. Over 400 indians were killed. So
    complete was the victory that the survivors
    joined other tribes and the Pequot Nation
    ceased to exist.
    The people of Windsor, Wethersfield
    and Hartford met in Hartford, 2 Jan. 1639 and
    wife, the sum of ten pounds during her
    material life, and in case I myself in my life
    time, or my wife after my decease, in her
    lifetime while she abides, to inhabit with my
    said son Timothy, she see cause or desire it, I
    do reserve power both for myself and for her,
    after my decease to dispose a barrel or two of
    cider and some apples yearly, without any
    harm to the premises, and likewise I do reserve
    like liberty for myself and my wife, to dispose
    of my wearing apparel, and whom we shall
    meet to enjoy them after our decease. Also I
    do give full power of bequeathing the great
    brass pan at her decease; and my son Timothy
    is to carry the improvements of the whole
    Estate, and to order and dispose of the stock,
    so far as the necessity of our subsistence shall
    require, and after my decease and the decease
    of my wife, my said son Timothy shall have
    and enjoy all my whole Estate fore mentioned
    to him and his heirs forever; always provided
    that in case my said son Timothy shall die and
    leave no natural heirs begotten by him, that
    shall either not attain the age of twenty one
    years or marry, then the one-half of my lands
    excepting the orchard and pasture down to the
    bridge, that goeth into the meadow; also the
    upper pasture by the house that shall belong to
    the house, shall return to William, the son of
    my son Samuel. Also my son Timothy is to pay
    out of the Estate: Imprimis to discharge my
    daughter Mary, with that which is paid, the
    sum of thirty-four pounds, which is the full
    portion I allow her. To my son William twenty
    shillings, to Samuel ten pounds, to Nathaniel
    fifteen pounds, to Joseph five pounds -- these
    legacies to my sons to be discharged within
    two years of my decease.
    In consideration of the premises we
    both have hereunto set our hands this 22nd
    day of April Anno Dom. 1660.
