Hervey was born in 1197 in Kilmaurs, Ayr, Scotland.1   Hervey's father was Robert de Cunninghame and his mother was Richenda de Barclay.  His paternal grandparents were Wernebald de Cuningham and <Unknown>; his maternal grandparents were Humphrey de Barclay and <Unknown>.  He was an only child.
