Herbert was born in 1245 in Carlaverock Castle, Carlaverock, Dumfries, Scotland.1   Herbert's father was Sheriff Aymer de Maxwell and his mother was Mary McGeachan.  His paternal grandparents were John de Maxwell and <Unknown>; his maternal grandparents were Roland McGeachan and <Unknown>. He had a brother named John.  He was the older of the two children.  He died at the age of 53 in 1298.1
