Narrative

Will of David Shelton, 1789 - LOUISA COUNTY VA.

AUGUST 7, 1789

In the name of God Amen I David Shelton of the County of Louisa being in
perfect health and understanding of a sound disposing mind and memory and
considering the uncertainty of human life do constitute and ordain this my
last Will and Testament.

Imprimis: I desire that all my just debts be first paid.
Item I give and bequeath unto my son Thomas all my lands in Louisa
County on the South side of the main road called the Old Mountain road also
the following Negroes (viz) Harry Abram Jinney and all her children my two
girls Anna and Anna and their future increase also one feather bed and
furniture to him and his heirs forever.
Item I give and bequeath unto my son Joseph all my lands in Louisa
County on the north side of the main road called the Old Mountain road, also
all that track or tracks in Goochland County on Wild Boar creek devised to me
by my brother Joseph Shelton also the following Negroes (viz) Isaac Jacob
Stephen and his wife Easter and her children Morning and Jinney the children
of Dol. Joe and his wife Judah and her children and their future increase
also one bed and furniture to him and his heirs forever.
Item I give and bequeath unto my daughter Elizabeth all the Negroes
she has in the possession and their future increase also one feather bed and
furniture to her and her heirs forever.
Item I give and bequeath unto my daughter Sarah all the Negroes she
has in her possession except my fellow Isaac to her and her heirs forever.
Item It is my will and desire that as I have already given unto my
daughter Sarah one Negro woman named Molly and two children more than her
proportion of what I have already given to my other children it is my will
and desire that my other children Thomas, Joseph and Elizabeth shall have out
of my estate not yet disposed of Negroes to the same value of the said Molly
and her children before a general division shall take place.
Item As there is a suit in law now depending John Shelton heir at law
of Joseph Shelton deceased for part of the Negroes of the estate of the said
Joseph Shelton it is my will and desire if the said John Shelton should
recover any of the said Negroes now in possession or of those in the
possession of any of my children the loss shall be equally sustained by all
my children.
Item I give and bequeath all my Negroes that is not already disposed
of to be equally divided among my children Thomas, Joseph, Elizabeth and
Sarah to them and their heirs forever. It is my will and desire that my
executors who I shall hereafter appoint, give no security for the executing
of this Will and that there be no appraisement of my estate. Lastly it is my
will and desire that after my just debts are paid that then all the residue
of my estate whether real or personal not mentioned above shall be equally
divided among all my children. And I do appoint my sons Thomas and Joseph
with James Watson to be executors of this my last Will and Testament hereby
revoking all others heretofore by me made declaring this to be my last in
witness whereof I have here unto set my hand and seal this 7th day of August
1789.

in the presence of us:
William Edwards, Wilson Addams
William Parrish, Charles Parrish and his mark.

At the Court held for Louisa County on the 11th day of September 1797; this
Will was this day exhibited in open Court by Thomas Shelton, Joseph Shelton
and James Watson executors therein named, and was proved by the oaths of
William Edwards, Wilson Adams, and Charles Parrish witnesses thereto and by
the Court admitted to record and the said Executors having made oath thereto
according to certificate is granted them for obtaining a probate thereof in
due form on their giving bond whereupon these executors entered into and
acknowledged their bond conditions as the law directs.
