    Notice it they spelled there name "Martial" and later "Marshall". The actual
    will is spelled the same way. Joseph paid for the land in PA current Money.
    Sugarland Run is just North of Dulles Airport on the Potomac.

    pp.IN THE NAME OF GOD AMEN. I JOSEPH MARTIAL of the County of Loudoun
    being
    304-sick and weak but of perfect sence and memory calling to mind that
    it is ap-
    30pointed to all men once to die do hereby make and ordain this my
    last Will and
    
    Testament, And as to what worldly goods it has pleased Alimighty God of his
    great mercy to Endow me with I give and bequeath in the following manner
    Viz. I give
    to my sons JAMES MARTIAL and SAMUEL MARTIAL the whole of my Lands in Loudoun
    County Being the plantation I now live on and which I purchased of JOHN
    CARLYLE
    gent of ffairfax Coty. To them jointly and their Heirs for ever. Together
    with all other
    my personal Estate upon the following conditions and restrictions Viz.
    ffirst of all
    during the Widowhood of my loving Wife RACHEAL MARTIAL they are to let her
    live in
    the small room of my Dwelling House and known by the name of her room. They
    are
    also to keep her up two Milch Cows and to pay her yearly three pounds Vif
    ginia cur-
    rency, fifteen bushels wheat and five bushells; of Rye or Indian Corn, She
    is also to
    keep her Bed and furniture and her large chest, likewise to receave yearly
    ffifty
    pounds of Pork and fifty pounds of Beef, But in case she should marry after
    my decease
    she is not intitled then to any of the above mentioned articles unless it be
    her Bed and
    furniture which she is take in full for all and every other matter or thing
    before
    mentioned. They are also to take care of and properly support and school
    their two
    young Brothers JOSEPH MARTIAL and ROBERT MARTIAL untill they shall arive to
    the
    age of Sixteen, when my desire is that they may be bound to Trades at the
    Discretion of
    my Executors hereafter named and when they arrive at the age of twenty one
    years to
    be paid thirty pounds cash as their full proportion of my Estate. They are
    to take care
    of Cloath raise and school there three young Sisters Vizt. MARY MARTIAL,
    MARGARET
    MARTIAL and RACHEAL MARTIAL untill they shall arrive to the age of Eighteen
    years,
    when they are to be paid Tventy pounds each as there full proportion of my
    Estate.
    They are also five years after my decease to pay their Sister MARTHA HANNAH
    Ten
    pounds as her full part of my Estate. And Whereas I am indebted to sundry
    people, My
    sons James Martial and Samuel Martial are also to pay those debts. If by
    their industry
    together with the produce of my crops now in the yard and growing they
    possibly can
    And in case that should prove deficient then my Executors must sell my Stock
    and Uten-
    sils of my ffarm at their Discretion for that purpose. And whereas my sons
    James
    Martial and Samuel Martial may prove Idle and Dissolute and fail to pay the
    several
    Legaces and Debts vhen due, My desire is in that case that my Executor
    shou'd sell the
    stock or land or such a part of the lands at their discretion as will
    ennable them to do it.
    My desire also is that my Wife Rachael Martial, ROBERT FFRYAR, SAMUEL SCOT
    and JOHN
    MOSS be my Executors of this my last Will and Testament. IN WITNESS vhereof
    I have
    hereunto set my hand and affixed my seal this Twenty fifth day of November
    in the
    Year of our Lord one thousand seven hundred and Seventy.

    At a Court held for Loudoun County April the 5th 1771 This Last Will and
    Testament of JOSEPH MARSHALL deceased was proved by the Oaths of Joseph
    Scott and William Ffox Witnesses thereto and ordered to be recorded, and on
    the motion of Rachel Marshall the vidov and Executrix, Robert Ffryer and
    Samuel Scott three of the Executors therein named who made Oath according to
    Law Certificate is granted them for obtaining a probate thereof in due form
    giving security Whereupon they together with JOSHUA EVANS and WILLIAM FFOX
    entered into and acknowledged their Bond in the penalty of one thousand
    pounds current money of Virginia conditioned as the Law directs, And Liberty
    is granted John Moss gent. the other Executor to join in the probate thereof
    at any time hereafter if he shall think fit.

    proved .. at another court held 9th October in year aforesaid .. further
    proved and ordered to be recorded.

    339Province of Pensylvania .. for sum Five hundred and twenty four
    pounds
    
    Ten shillings current money of Pensylvania .. by deeds of lease and
    release .. sold parcel of land situate in county Loudoun on the Sugarland
    run .. containing 524 acres as by survey thereof made by GEORGE WEST appears
    .. being part of a greater tract taken up by JAMES THOMAS by Proprietor's
    deed bearing date 28th March 1727 ..

    Loudoun County Sct. George the Third .. to JOHN WEST, ROBERT ADAM and JOHN
    WEST JUNR. Gent. .. whereas John Carlyle Gent. and Sibyl his wife by their
    Indenture .. have sold unto Joseph Marshall the fee simple estate of 52411
    (sic) acres of land .. and whereas said Sibyl cannot conveniently travel to
    our Court .. examine her privily and apart from her Husband .. whether she
    doth the same freely and voluntarily .. and whether she be willing same to
    be recorded .. 20th June 1764.
    
    Fairfax Sct. In obedience .. have privily examined Sibyl wife of John
    
    Carlyle Gent. .. said Sibyl freely and voluntarily without persuasions or
    threats consents to and is also willing that same shall be recorded .. 20th

    on side of main road near a branchbetween Coleman's and THOMAS

    fencescontaining 84 1/4 acres as by survey thereof made by George West
    appearsof which lots or parcels of land are part of a greater tract
    of
    land taken up by JAMES THOMAS by Proprietors deed bearing date 28th March
    1727 ..

    county Loudoun and whereas said Sibyl cannot conveniently travel to our
    Court .. receive the acknowledgment she shall be willing to make .. 20th

    The other Samuel Marshall noted in Loudoun County was Richard Marshall's
    (1698-1750) son from Charles County (Marshall Hall Ancestor). Thomas
    Marshall (1693-1759) noted below is the Marshall Hall Line.

    There was a Samuel Marshall in the far western part of MD abt.. late 1790s
    or early 1800s.. Believe he migrated from Loudoun Co, Va to there. (Having
    cousins living in Fred. Co, Md.) That portion of MD would be a natural
    place from which a father or grandfather might migrate on west. But there
    are dozens of Samuel Marshalls everywhere.

    OTHER BROTHERS WRITTEN BY HIS MARRIED SISTER. I CAN LOOK THIS UP IN MY MISC.
    MARSHALL FILES IF ANYONE NEEDS THIS. I TOO HAVE A SAMUEL MARSHALL, BORN CA.
    1750 (WHERE?) - SOME SAY PA. BUT I THINK HE WAS BORN IN VA.) MARRIED FANNIE
    HAZELRIGG OF PR. WILLIAM CO., VA., NEXT DOOR TO LOUDOUN CO. THEY LIVED IN
    WASHINGTON CO., PA AND ACROSS THE LINE IN OHIO CO., (W) VA. THEY MIGRATED TO
    ADAMS CO., OH. AND THEN NEXT DOOR TO SCIOTO CO., OH. IN THE LATE 1790'S.
