Page 269 - Amos Hurvey vs Thomas W. Buchanan & others Filed

Amos Hurley, Thomas J. Gaddy, Jasper M. Gaddy, Martha
Gaddy, Mary Gaddy, Mariam Gaddy, the last two are minors
with no guardian, and present their petition by their
brother and next friend Thomas J. Gaddy, Robert Davis and
Matilda J. Davis, states that many years ago Mary Hurley
was the wife of Elijah Hurley and by whom she had four
children, to wit, Amos Hurley, Sally who married with May
Buchanan, Elizabeth who married with Archibald McElroy,
Martha who married Leonard Smith. Many years ago Elijah
Hurley died in Lincoln County, Tennessee and that Mary
Hurley had slaves and after she (Mary Hurley) married
Absalom Davis and afterwards and about 16 march 1826, said
Absalom Davis and his wife Mary sold said slaves &c over to
Amos Hurley, Sally Buchanan, Elizabeth McElroy and Martha
Smith, the children of Mary Davis by her first husband, and
Polly Davis, Letty, Sally, Henry Davis, Constant M. Davis,
William Davis and Robert Davis, children of Absalom Davis
by a wife he had before Mary Davis. Mary Davis departed
this life in 1852 and Absalom Davis departed this life in
1854. Polly Davis married Alexander Hughey and had seven
children, to wit, Parthenia who married John C. Euniss who
lived in Alabama, Mary, Franklin and Robert of full age,
Sarah, Martha and William in Lincoln County, Tennessee and
that John C. Euniss is guardian of minors of Alexander
Hughey. Alexander Hughey died many years ago and his widow
Polly remarried with Washington Wilson and then died
without having any children by Wilson, leaving Wilson
surviving her and who now lives in Lincoln County,
Tennessee. Letty Davis married John Keith of Mississippi.
Sally married Thomas W. Buchanan. Henry Davis died, leaving
Robert C. Davis and Matilda J. Davis his only children.
Constant W. Davis lives in Williamson County, Tennessee.
William Davis died leaving three children, John D., Robert
and Letitia, minors and lives with Constant W. Davis and is
their guardian. Robert Davis died many years ago leaving no
children and never married. May Buchanan and wife Sally
about year 1849, transferred interest in slaves to Amos
Hurley and Davis S. Buchanan (Registered in Lincoln County,
Tennessee). Martha married Smith and had children, to wit,
Sarah and William B., of full age, transferred their
interest of said slaves to Amos Hurley and David S.
Buchanan. Leonard Smith died and his widow Martha remarried
Samuel Gaddy, by whom she had, to wit, Jasper, Thomas J.,
Martha, Mary and Mariam Gaddy and then she and her last
husband have both died. Elizabeth had by her first husband
Archibald MeElroy, children, Mary who married John M.
Commons and lives in Obion County, Tennessee, Sarah who
married Davis S. Buchanan and she then died leaving her
husband and one child and said child died and then said
David S. ________, Jackson Perry and William McElroy who
lives in Mississippi. Benton McElroy of Lincoln County,
Tennessee, Martha married Salomon B. Smith and lives in
Obion County. Elizabeth who married Theodore G. Smith and
died leaving her husband and one child and lives in Lincoln
County, Tennessee, Archibald McElroy died and Elizabeth
remarried Lewis Ship and had one child Orlena, a minor.
Then Elizabeth died leaving her husband Lewis Ship and her
child, living in Lincoln County, Tennessee. David S.
Buchanan died in Lincoln County Tennessee, Robert
Farquarson was appointed admr. of Said Daivd.
Answer of Thomas W. Buchanan, 1858: Buchanan said in 1844
purchased form Samuel S. Buchanan a Negro woman Tennessee
for sum of $380.00. S. S. Buchanan purchased form Absalom
Davis the said Negro woman September 24, 1840 for $320.00.
Tennessee was a descendant of Violant.
NOTE: Lincoln County, Tennessee records are: Elijah Hurley
died before 1820 (census), left widow Mary Hurley (Davis),
over 45 years of age. Absalom Davis, born ca 1787 North
Carolina, died ca 1854 Lincoln County, Tennessee. Mary
(Hurley) Davis, born ca 1776 North Carolona, died ca 1852

Mary born February 24, 1797, died August 17, 1852, buried
Wright Cemetery, Lincoln County, Tennessee. Children:
Marion born ca 1819, age 21 in 1850 census, Amos H. born ca
1828, age 12 1850 census, Washington born 1842 (8 years)
1850 census. Next house is Zachariah Hurley born ca 1817
(23 years) 1850 census. 2- May Bucanaan and wife Sally 1850
Lincoln County TN Census, May Buchanan born 1788 North
Carolina, Sarah (Sally) Hurley born ca 1798 North Carolina,
children, Sarah 19 years in 1850. 3- Archibald McElroy
already dead by 1840 Lincoln County census. He made his
will December 13, 1839 in Lincoln Coutny. His wife was
Elizabeth Hurley McElroy.S
