" In chambers at the Supreme Court before His Honor Mr. Justice B. J. Douglas on Friday morning an appli- cation was made for judgment absolute in the matrimonial action James Henry Oshyer, plaintiff, and Beatrice Maud Oshyer, defendant, and Norman Johnson, co-defendant. This action was heard before His Honor, Mr. Justice R. J. Douglas on October 14, 1941, when an order nisi was granted for dissolution of the marriage solemnised on October 23, 1931, at Townsville, between the plaintiff under his then name of James Henry McAllister and Beatrice Maud Oshyer. An affidavit by the plaintlfl admitted he had not disclosed to his solicitor the circumstances of his relations with another woman prior to the hearing of his petition In October, 1941. If granted a Judgment absolute he was prepared to marry this woman. His Honor's decision was: Order nisi is discharged, and the petition is dismissed."

"PETITIONER REFUSED JUDGMENT ABSOLUTE
TOWNSVILLE, Friday— In the Supreme Court to-day, in chambers, Mr. Justice R. J. Douglas dismissed an application for judgment absolute in the matrimonial action, James Henry Oshyer v. Beatrice Maud Oshyer and Norman Johnson (co-defendant). An order nisi was granted on October 14, 1941. An affidavit by James Oshyer, presented to the judge, admitted that he had not disclosed the circumstances of his relations with another woman to his solicitor prior to the hearing of his petition in October. He stated that if judgment absolute were made he was prepared to marry this woman. Dismissing the petition, his Honour discharged the order nisi."
