"Joseph Higginbotham (son of Moses, Sr.) died in Amherst County, Virginia in 1827. His will was proved September 17, 1827. See Will Book 7, page 34.
He willed his son James S. Higginbotham during his natural life and no longer, all the land that he might have in his possession at his death except his right and title to a part of a tract of land belonging to the estate of his brother Charles Higginbotham. Also a negro man named Pleasants, and "all my Household and Kitchen Furniture except my feather beds and furniture; all my stock of Horses, cattle and Hogs, and one half my stock of sheep, and one half of all my Negroes, exclusive of the one already mentioned"
At the death of James S. Higginbotham, to his lawful issue, in default of which, then grant to the children of testator, children of his daughter Frances McDaniel, viz: Joseph, James, Preston and Mary. Also to said grandchildren "one half of all the Negroes I die possessed of." The best bed that I have goes to my grand daughter, Mary McDaniel"
Witnesses: James Higginbotham, Saml. W. Christian, Eugene Higginbotham.
In a codicil to his will, dated September 6, 1827, he leaves to his son James S. Higginbotham, "a fee simple Title to the Tract of Land I now live on containing about 100 acres," also two Negroe boys, Reuben and Zackeria.
Witnesses: Jesse Higginbotham, Allsion Ogden, Eugene Higginbotham
Executor's Bond $10,000.
Securities: Thomas Higginbotham and John Penn
Jospeh Higginbotham came to America from Ireland. He was living in Virginia in 1751. He married Frances Riley. Moses, a son, and father Joseph, died in Amherst County in 1791.
