CIVIL ACTION TO CORRECT ERROR IN THE DESCRIPTION OF REAL ESTATE
Andrew J. Coots et al - Plaintiff v Catherine Caby - Defendant
Now comes the plaintiff by their attorney and if appearing to the court that the said
defendant Catherine Caby is an infant and under the age of eighteen years and that
although duly served with process to appear and defend in the above entitled cause she
has failed to appear on the first day of the term and ***** the appointment of a guardian
to defend said suit it is therefore ordered by the court that Alexander Barrett Esqr. Be
appointed as guardian ad litem to appear and defend said suit in the name of the said
Catherine Caby and the said Alexander Barrett being present in court accepts such
appointment and agrees to act as such guardian ad litem for said minor.

Civil action to correct a mistake in a deed
Andrew J. Coots and Wilhelmina Coots his wife Plaintiff
Catherine Caby a minor by her guardian ad litem Alexander Barrett Defendant
Now comes the plaintiff by all or next and Catherine Caby by guardian ad litem and this cause
coming on to be heard and both parties waving this right to a jury trial and consenting to a trial of
said cause by the court; and all and singular the matters being submitted to the court and being
seen and heard the court doth finds that one Frederick Caby late of Bollinger did seized and
possessed of te following described real estate situated in said county South No. One (1) and the
East Half of South No. Two (2) and the South West quarter of South Number Two (2) all in the
South West quarter of Section Eighteen in Township Twenty Nine (29) North of Range Nine (9)
East that is his life time he was twice married that by the first marriage there was born unto him
Wilhelmina Caby one of the plaintiffs in this cause now intermarried with said Andrew J. Coots.
That by the second marriage there were born unto him, Daniel, Julia Ann, Henry, Adaline, Dorah
and Frederick Caby (Jr.). That said Frederick died left surviving him Christena Caby as his
widow and that three years after his death this defendant Catherine Caby was born unto the said
Christena Caby who has since departed this life with out having again married leaving said
defendant Catherine Caby as one of her legal heirs. That one Daniel Myers was duly appointed
and qualified as administrator of the estate of said Frederick Caby dec'd and as such under the
direction and by the order of the county clerk of said county he sold at public sale for the
payment of the debts of the deceased the following described portion of said real estate to whit
the South No. One and the South West quarter of South No. 2 of the South West quarter of
section Eighteen (18) in Township Twenty Nine (29) north of Range Nine (9) East and said sale
said Christena Caby was the purchaser of said real estate and that said administrator in making
its deed to said Christena Caby by mistake inserted the East Half of South No. Two of the South
West quarter of section Eighteen (18) Township 29 North of Range 9 East as a description of a
part of the land sold when the same was not sold at all at said sale made as aforesaid abut
remains the property of the heirs of said Frederick Caby dec'd of whom the said Wilhelmina
Coots is one but who is not an heir of said Christena Caby dec'd. It is therefore ordered
considered and approved by the court that said deed executed by said Daniel Myers
administrator of the estate of said Frederick Caby dec'd to said Christena Caby be corrected and
reformed so as to not include the said east half of south No. two (2) of the south west quarter of
sec 18 township 29 range 9 E and
