Dear Bro: I shall come to Judson on Sat. May 4th 95.  I shall not drive through, as I have failed so far in getting my horse home.  This leaves us well.  Onions are big enough to eat, & of course my talk is very strong.  I am as limber now as a boy only 16 - Can sit down with out dropping 4 inches, can run up or down stairs.  Wheels are good for some purposes, especially are they good for wagons, ect. but for a 240 lb. I, John A. Payton, Parks county state of Indiana being of sound mind and disposing memery do make and publish this my last will and testament hereby revoking all former wills made by me.
Item 1.
It is my Will that all my just debts, funeral expense and all legal charges be first paid out of my estate.
Item 2.
It is further my Will, that the five children by my first wife, Lucinda J. Payton, towit; Laura Burke, Etta Guilliams, Marion Payton, Rudy Payton Fred Payton--shall have 20 acres of land which was given said Lucinda, by her father--but the deed made to me, and which in fact belongs to said Lucinda J. Payton--my first wife, and is described as follows The north half of the north est quarter of the south east quarter of sec 32, township 16 north range 6 west Parks county, Indiana--being 20 acres heired by said Lucinda J. Payton as aforesaid.
Also said children by my first wife shall have the sum of $500, each which came to my first wife from her father P.D. Johnson, which said realty and personalty shall be given said children of my first wife--share and share alike; the said $500. herein to drwa no interest from time of gift.
Item 3d.
It is my Will that teh children by my 2nd wife, Raymon and Ivah shall have each a fair horse cow, bed and bed clothes and ther things for housekeeping purposes--the same as the children by my first wife recd.
Item 4th--after payment of the above bequests and legacies--it is my will that my beloved wife Sarah E. Payton shall have one third of the remainder or residue of my estate--both real and personal; the one third of realty to my said wife to be set off to her, where the present buildings are situated.
Item 5.
It is further my Will that after payment and distribution of my estate as above set out--that the remainder and residue of my said estate both ral and personal shall be equally divided share and share alike between all my children above enumerat
I hereby nominate and appoint Wallace Stokes as Executor herein.
In witness hereof I have hereun to set ymy hand and seal this the 24th day of Jany 1910.

DEATH: Terre Haute Tribune death notice (12/23/45) - Marion A. Payton, 69years old, died at 2:30 o'clock Saturday afternoon at his residence near Judson.  He is survivied by the wife, Anna; one daughter, Mary Margaret of Indianapolis; one brother, Fred Payton, of Rockville; two sisters, Mrs. Lary Burkes, of Gary, and Mrs. Ella Williams of Crawfordsville; one half brother, Raymond Payton; and one half sister, Mrs. Harold Payton, both of Rockville.  The body was taken to the Barnes Funeral Home, where funeral services will be held a t 2 o'clock Monday afternoon.  Rev. Raymond Skelton will officiate. Burial will be in Mt. Moriah Cemetery.

1920 census: Farmer.  1920 Farmer's Directory: Post office of Marshall, Section 2, owns 80 acres.  Lived in county since 1877. Listed in Judson telephone directory.  Daughter Carrie's 1925 marriage registration has him as clerk in Marshall.  1930 census: Hardware store clerk.  Known as Uncle Pud to Eleanor Burks Carter.

1887 - 1887 Mary Elizabeth PAYTON 4m 4m DEATH: One cemetery record has death on August 12. 1801 - 1853 Anthony PAYTON 52 52 Ancestry.com "Kentucky Marriages to 1850" has marriage listed twice, onceas Anthony Peyton and once as Joseph Peyton.
Ancestry World Tree in Database 1866988 has Anthony's mother as his father's other wife, Elizabeth Olwel.

Could not find Anthony Payton (or Peyton) in 1820 census in Kentucky.  There is an Anthony Payton in Westmoreland Co., Virginia but this appears to be an older man.  He could be Joseph in 1820 census (see marriage note above).
BIOGRAPHY: Land patent issued January 3, 1832 for 69.56 acres in Parke Co. (BLM Document Nr. 14470, Accession/Serial Nr. IN1160_.174.
Barbara Carter - On July 1, 1831 purchased 6 acres at W1/2 SW1/4.
(Account from 1893) Anthony was born in the Old Dominion (Virginia) in 1801, and removed with his parents to Kentucky in his early youth. (Lived in Mason County.)  In that state he married Miss Margaret, daughter of Mark Wallingford, who was an early settler of the Blue Grass region.  To this worthy couple were born four children while in Kentucky, and in 1828 the family removed to Indiana, settling in Greene Township, Parke County, on section 22, where his the father (referring to Anthony) rented a farm for four years.  In 1831 he located near Bellmore, in Union Township, where he entered land.  He was one of the first settlers of the township, and he at once commenced piling brush and clearing a place to raise food for his family, and so diligently did he work that before the spring had passed five acres were ready for seed.  Six children were born to Mr. and Mrs. Payton in this county.  Only four of the family now living, viz.: Mrs. Julia Lewis of Sullivan County, Ind.; James. F., a resident of Greene Township; John L., of Sullivan County, Ind., and our subject (Thomas).  Anthony, who was a member of Predestinarian Baptist Church (Mount Moriah), died October, 1853.  His wife, who held the same faith, survived her husband nearly half a century, her death occuring in December, 1882.  Mr. Payton was a strong Democrat, and was actively interested in the welfare of this region, to the development of which he contributed in no small measure.

I, Anthony Payton, of the County of Parke in the State of Indiana do make and publish this my last will and testament hereby revoking and making void all former wills by me at any time heretofore made.  First, I direct that my body be decently intered and as to such worldly Estate as it has pleased God to entrust me with, I dispose of the same in the following manner (to wit): I direct that all my just debts and funeral expenses be first paid.  I further direct that my wife, Margaret Payton, shall have possession of the farm in which I now reside and also the personal property and the profits of the same for the support of herself and the three children that are now at home as long as hse remains my widow.  I direct that Laureny Douglass, John L. Payton and Harvy Payton to have a good common education and I direct that said Laureny, John and Harvy shall have as good setting out as I have given my other children. I direct that my son James Payton to be my Executor, and further I direct that said James to superintend the farm and to manage the business for my family, and in case of his death or inability to do so then and in that case, I direct my son Thomas to take charge and manage for the family as James is directed to do, taking receipts for all money paid out so that it may be satisfactory to the family, and also keep an account of all moneys paid to him for the benefit of my family, and I further direct that said James or said Thomas to be paid a reasonable compensation for their services out of the profits of my Estate and at the death of my wife Margaret, I direct that all my property and Estate to be equally divided among all my children share and share alike whose names are Julina, William, James, Mary, Thomas, Laureny, Douglass, John L. and Harvy, and I further direct that my farm shall not be sold or divided until the youngest child arrives at the age of twenty years, provided however if a majority of my children that is twenty one years old shall be in favor of selling then in in that case I direct that my farm may be sold.  In testimony whereof I, Anthony Payton, the testator have hereunto set my hand and seal this twelfth (12th) day of August in the year of our Lord, one thousand eight hundred and fifty three (1853).  (Witnessed by Jesse Maticks and Zebulon Collings and delivered to probate by them on November 22, 1853.) 1804 - 1882 Margaret WALLINGFORD 78 78 Alternate spelling Wallingford (Barbara Carter).  1880 census may haveinitial of P for first name with Margaret as a middle name.

From obituary: After the marriage of the son to Laura Collings, the homes of father and son have been very closely connected.  He had a keen interest in the activities of the community and in the welfare and success of his two grandchildren and their companions.  He joined Otterbein United Brethern Church in June of 1922. Some of his happiest times were when he was taking the children to Sunday School.  [Granddaugther Vera Payton Cooper recalls how he would pick up her and brother Keith and several other cousins on Sunday mornings to bring a car load of grandchildren to church.]

Payton, 69 years old, died at 1:30 o'clock Sunday afternoon at his home, southeast of Rockville.  He is survived by the widow, Katherine; a son, Hubert Payton of Rockville; a stepmother, Mrs. Sarah E. Payton of Rockville; a half brother, Raymond Payton of Rockville; a half sister, Mrs. Iva Berry of Rockville; two sisters, Mrs. J.R. Burks of Gary, and Mrs. Charles Guilliams of Crawfordsville; two grandchildren and two great grandchildren.  The body was taken to the McMullen Funeral Home.  Services will be held at 1:30 o'clock Wednesday afternoon at Otterbein Church, and burial will be in Mount Moriah Cemetery.

1825 - 1893 James Franklin PAYTON 68 68 BIOGRAPHY: Greene Biographies on Parke County Website: Farmer, Parkville,a pioneer of Green Township; at the age of two and a half years came to Parke County with his parents.  Mr. Payton and his wife are members of the Predestinarian Baptist church, at Mt. Douglas.  Crooks Family Genealogy has name as Larmous.  Nadler has Louisa D. Payton born in 1842; this could be another child not recorded by others.

Sharp, son of Isaac and Mary Ann Eastlack Sharp, wasborn August 7, 1853.  He died at his home in Bellmore early on Sunday morning, February 10 at the age of 75 years, 6 months and 3 days. He was of a family of 13.  Those surviving are Mrs. James Barr, Theodore M. Sharp, Charles L. Sharp and John R. Sharp of Waveland, Alva Sharp of Montezuma, Otho Sharp of Chicago Illinois and Frank Sharp of Indianapolis. He united with the ME Church in Waveland in early life.  He united with the ME Church at Bellmore, July 31, 1881 under the pastorate of Rev. D. T. McClain and was a faithful steward of the gifts of God committed to him.  Time, health, strength, mental ability, all were trusts to be faithfully administered.  he was united in marriage to Emma Gailey. To this union one daughter was born.  The mother and daughter preceded him in death.  he was again united in marriage to Mary Reid, with whom he lived happily for many years until she was called home.  On June 5, 1907 he was united in marriage to Mrs. Belle Rein, who was a devoted wife and who today mourns his loss.  Mr. Sharp was a painter by trade.   He was twice appointed postmaster at Bellmore and was serving in that capacity at the time of his death.  His was the life of a consistent member of the Knights of Pythias and Red Men's orders.  He firmly believed in their tenents and teachings. He had faith in his friends, his country and his God and as such a man he will be missed.   A friend suggests this quotation as exemplifying his life: "He was gentle, the elements of greatness and sweetness were so wrapped up in him that all the world might stand and say, "This was a man.""  Mr. Sharp was born in Russellville but later moved with his parents to Waveland.  While living here he fell from the runway in the rear of his father's shop, the present Poney Moody house on to a rock and suffered a compound fracture of the left arm.  It became necessary to amputate the limb above the elbow.  Notwithstanding this handicap he became an expert painter and decorator.  Those from Waveland attending the funeral were Mr. and Mrs. James Barr, Mr. and Mrs. Ira Sharp, Mr. and Mrs. Ray Sharp and Floyd, Theodore Sharp, Otho Sharp, Charles Sharp and Frank Sharp.     - Waveland Independent, February 15, 1929 BET 1860 AND 1861 Mary C. Mrs. Charles SMITH died at her home on W. Main St. on Saturday after but a few days illness with heart trouble. Funeral services at the Christian Church on Monday afternoon were in charge of Rev. Cecil Franklin. The pall bearers were John Oldshue; Lee Foster; John Reynolds; Walter Penn; Frank Wilkinson and Edgar Pitts. The flowers were carried by Mrs. Huber Loudermill; Mrs. Ray Sharp and Mrs. Chester Heslar; Mrs. Franklin; Mrs. Fred Rice; Corta Dooley and OG Swanay sang with Mr. Walker at the piano. Burial at Indian Creek. Bertha PAYTON Smith daughter of William and Mary Payton, was born at Parkville, Indiana Sept 7, 1888. She departed this life at her home in Waveland August 16, 1933 age 44 years, 11 months 19 days. Her life was spent near the place of her birth and in the vicinity of Browns Valley. She was married to Charles Smith on November 5, 1908. To this union four children were born 3 of whom survive, Mary Ethel having pass away at the age of one year on January 24, 1914. After spending several years in the community around Browns Valley and Russellville, the family moved to Waveland where they have since resided and the death of the husband, Charles Smith occurred on August 7, 1928. Mrs. Smith, tho' frail in body always forgetting self and unmindful of her own health, strived diligently to rear the family and keep the little home together, never calling upon friends for assistance until she was forced to do so. She was of a quiet, unassuming nature, always having a kindly feeling to those about her. The large circle of friends and neighbors bespeaks the love and esteem in which she was held. Her Christian life will ever be a guiding light and high example for her children. After life's fitful season filled with sad disappointment, she rests from her labors. She is at home with the Father. She held membership with the Browns Valley Baptist Church. Those left to mourn her loss are 3 sons: Walter, David and Charles; the father and step mother, one sister, Mrs. Chloe Sollers of Clinton; one half sister and 3 half brothers, a host of other relatives and friends.

In 1820 census there is a John Payton in Mason Co., Kentucky.  This could be him with his father (male age over 44), although the next oldest male is a bit young for birth year of 1791.

In 1830 census there is a John Payton in Mason Co., Kentucky with two males age 5 to 10, two females age under 5, one female age 5 to 10, one female age 10 to 15, one female age 15 to 20, and one female age 20 to 30 (presumably his younger 2nd wife and children from 1st wife).

School system for 33 years, where she also did work with the Child Study Department. She was born Jan. 9, 1897, in Greene Township, Parke County, to J.R. Burks and Laura Payton Burks. She was preceded in death by her husband, Walter Royse, in 1970. Survivors include one daughter-in-law, Sarah Royse of Decatur, Ga.; one sister, Eleanor Carter of Rockville; three grandchildren; and three great-grandchildren. She was also preceded in death by one son, Robert Royse, in 1990; and one brother, Paul Burks. She graduated from Rockville High School, Western College in Oxford, Ohio, and received her master's degree from Northwestern University in Evanston, Ill. She was a member of United Methodist Church and Methodist Service Circle. Graveside services are 11 a.m. Thursday in Rockville Cemetery, with the Rev. Jack Steele officiating. There is no visitation. DEATH: Waveland Independent, April 26, 1918 -- Daniel M. Swaim, living W. of Bellmore, met death Monday afternoon while blowing stumps with dynamite on his farm.  Mr. Swaim was alone at the time and it will never be known just how the accident happened. He left the house shortly after noon and was found by his son, Edgar about 3 o'clock. The injured man was carried to the house and lived until about 9 o'clock Monday night. The force of the explosion seemed to strike him in the face and chest and his features were badly disfigured. Daniel Swaim, 63 years old, was a man well liked by his large circle of friends and acquaintances; he was industrious and often referred to as the hardest working man in Parke Co. Besides the widow he is survived by one son, Edgar and four daughters, Mrs. Frank Crooks and Mrs. David Jacks of Union Twp; Mrs. Fred Crooks of Greene Twp and Miss Ina, living with her parents (Rockville Tribune) Mr. Swaim was a former citizen of this township, living for a number of years on the farm east of town owned by Dr. Arthur Kleiser. The funeral at Mt. Moriah Church on Wed. was in charge of Elders Dodimead and Airhart.

Thomas Payton, one of the well-to-do and enterprising agriculturists of Greene Township, Parke County, owns a substantial residence, which he erected at a cost of about $3,000 on his fine farm, which is situated on Section 21. He is engaged in missed farming, keeps a first-class variety of stock of all kinds, raises thorough-bred Poland-China hogs, and has some very good horses. Mr. Payton is much interested in the success of the Democratic Party, has filled the office of Committeeman of the township, and has been a delegate to the state, and also to Congressional conventions. Thomas Payton was educated in the public schools of Parke County, where his birth occurred on the 12th of May 1832. He lived with his father until his marriage, on May 6, 1852, with Miss Martha Ann Stout, who was born in Kentucky September 12, 1833. Her father, James Stout, emigrated to this state form the Blue Grass region in 1834, locating in Union Township, where he resided until his death in May 1889. He entered land of the Government, opened up a farm, and in time became the owner of several hundred acres. His wife was formerly Rhoda Maddox, and by her marriage she became the mother of seven children. Those living are Mrs. Payton; Mary Jane Connolly, who lives in Union Township; William P. and James O., who live in the same place; Sara E., deceased; and Rebecca F., Mrs. John A. Rush, who lives in Iowa. After his marriage, Mr. Payton located in Union Township, where he rented land for five years, and then purchased one hundred acres in the same township. This was in 1858 and he at once moved to the farm on which he lived for seven years, then removing to his present farm. At first he owned one hundred and twenty acres of this place, to which in 1875 he added fifty acres more. For about thirty years he has been engaged in carrying on this farm, which is now one of the most desirable in the township. Mr. Payton is a man of considerable mechanical genius, and in August 1891, he constructed an appliance that, by means of a hydraulic ram and tanks, furnishes water for his stock in all parts of the farm. The pleasant home of the Payton family is one of the best in the county, and, unlike the usual residences of farmers, is thoroughly warmed in all parts of the building during the winter season. Mr. Payton is a member of the Predestinarian Baptist Church, attending Mount Moriah Chapel, to which his wife also belongs. He is quite a musician and leads the singing of the choir. It is safe to say that few men in this region are more honored and respected than is the gentleman of whom this is a brief life record.

He was the recipient of 156 cards, for which he feels very grateful. The day was made still more memorable by Mrs. George McMurtry, the daughter with whom he makes his home, inviting a few of his older neighbors to take dinner with him. There were present: Mr. and Mrs. Robert Clark, J. C. Strong, J. S. Clark, and daughter, Miss Mary, his eldest daughter, Mrs. Jacob Collings, and Mr. and Mrs. H. L. Britton and daughter, Miss Carrie."
