This Indenture made this nineteenth day of December in the year of our Lord Christ one Thousand Seven Hundred and Seventy Six between JOSIAH SEAY of the County of Amelia of the one part and LUCY SEAY of the same County of the other part witnesseth that the said JOSIAH SEAY for and in consideration of the said LUCY SEAY having already relinquished her Right of Dower in the tract of land where on her husband, JAMES SEAY, lived at the time of his Decease, and also for and in consideration of the sum of five shillings in hand paid by the said Lucy Seay to the said JOSIAH SEAY the receipt whereof the said JOSIAH doth hereby acknowledge have given, granted, bargained, and sold to the said LUCY SEAY, all that tract or parcel of land that JAMES SEAY, FATHER OF THE SAID JOSIAH SEAY purchased of Shem Cook containing by estimation two hundred acres be the same more or less.
Beginning at a coner on James Jenkins and Thomas Wingoes line thence along the said Wingoes line to a lightwood corner and from thence to Luck's Creek thence down the Creek to James Jenkins' line thence along the said line to the beginning
To have and to hold the said land with the appurtenances unto the said LUCY SEAY during her natural life and from and immediately after her desease to her four sons, JAMES SEAY, REUBIN SEAY, MATHEW SEAY, AND CYRUS SEAY, for and in consideration of the natural love and affection the said JOSIAH SEAY bears for his FOUR BROTHERS to be equally divided according to quality and quantity among them to have and to hold the same with the appurtenances to them and their heirs assigns forever together with all the houses, orchards, weeds, underwoods, waters and courses thereunto belonging or in any wise appertaining and the said JOSIAH SEAY doth for himself and his heirs covenant and agree to and with the said LUCY SEAY and her FOUR SONS, JAMES, REUBIN, MATHEW AND CYRUS SEAY that he the said JOSIAH SEAY the above land the premises? and to them and their Heirs and Assigns forever shall and will warrant and forever defend in witness whereof the said JOSIAH SEAY hath hereunto set his hand and affixed his seal the day and year above written.
