UN TY KENTUCKY CIRCUIT COURT - Filed 15 March 1883 - Case no 3349 & 4898.
The plaintiff, the Commonwealth of Kentucky states that it is the own
er a nd entitled to the possession of a certain tract of land situat
ed in Barr en County, Kentucky, near to and east of Glasgow Junction descr
ibed and bo unded as follows, to wit: Beginning at a stone Adams corn
er S 1/2 E 80 pol es to a post oak thence S78 poles to a post oak, N70W 1
11 poles to a po st oak on the Preston line thence N3 1/2E 178 pol
es to a black jack by t he side of an old oil field, thence S59E 116 pol
es to the beginning, conta ining 114 acres. The plaintiff states that t
he defendants Nathan Basham, H enry Basham & S H Boles now unlawfully ho
ld possession of the same tra ct of land and for five years last past with
out right have kept the plaint iff out of the possession of the same where
by the plaintiff has been damag ed in the sum of one thousand dollars. Whe
refore the plaintiff sues and pr ays Judgment for the money out of the sa
id tract of land and for one thous and damages and for all proper relief.

nd filed in t his Court by one Lewis McQuown and one W L Porter, Attorney
s. Now affia nt states that said McQuown and said Porter nor neither of th
em had when s aid action was filed nor have they or either of them now a
ny authority fr om the Commonwealth of Kentucky to bring file or prosecu
te said action a nd the same is now being prosecuted against them witho
ut the authority, sa nction or procurement of the commonwealth of Kentuc
ky and they now ask f or a rule against said McQuown and Porter to sh
ow by what authority or rig ht they brought and now prosecute said actio

ANSWER - Filed 26 Apr 1883 The Defendants, Nathan Basham, Henry Ba
sh am & S H Boles for answer say that it is untrue and they deny that t
he Pla intiff the Commonwealth of Kentucky is the owner and entitl
ed to a certa in tract of land in Barren County situated near to and ea
st of Glasgow Jun ction (now Part City) and bounded as follows (descripti
on given as in abov e) containing 114 acres or any other quantity, they de
ny that the Pl ff is the owner or any port of it, they deny that they t
he Defts now unlaw fully have possession of the land or any part of i
t, or that they have f or five years or any other period of time last pa
st without right kept t he Plaintiff out of the possession of the sa
me - or that the Plff has be en damaged to the amount of one thousand doll
ars or any sum of money, th ey deny that S H Boles has ever been in posses
sion of said land or any pa rt of it, they say that Nathan Basham and Hen
ry Basham his Tenant is in t he possession of the whole of said land and N
athan Basham is the own er of it.
Paragraph 2 - Defendants further answer and say that they are advis
ed th at the pretended claim and title of the Plaintiffs to the above desc
rib ed tract of land is based and furnished upon a pretended deed of conve
yan ce purporting to be made to the Commonwealth of Ky by one John H Dunha
va n, conveying to the Plaint
